    This week's ICSC-Goldman report on store sales highlighted strength at department stores (M, JWN, KSS, JCP, SKS, DDS, SHLD, BONT, TJX) during the Memorial Day weekend. It's a positive sign for the sector after the weather was widely blamed for the sluggish start to the spring selling season.

    Kohl's (KSS) names Michelle Gass to the newly created position of chief customer officer to oversee areas including e-commerce and marketing. The exec comes from Starbucks where she was president of Starbucks Europe, Middle East and Africa.

    Retail legal rumblings: An appeals court in California rules that Kohl's (KSS) can be sued over what consumers perceive is false advertising. The court said California consumer law will allow lawsuits in cases where a customer would not have made a purchase except for the false bargain. The ruling could set up an avalanche of similar lawsuits in California against retail chains.

    More on Kohl's (KSS) Q1: Comparable store sales fell 1.9% during the period, although trends improved near the back end. The company says inventory levels were consistent with expectations. Store count increased 21 to 1,155. (PR)

    More on retail sales: Building material and garden equipment sales (HD, LOW) were again, up 1.5% M/M and 4.1% Y/Y, while department store sales (SHLD, KSS, M, JWN, JCP) trailed expectations. Grocery store sales (KR, SVU, SWY) slipped during April compared to March but were 2% than a year ago on pricing gains.

    Retail sales numbers for April could be a tad weaker than expected after weekly reports from Redbook and ICSC-Goldman on chain store sales both came in a bit below expectations. Retail read-through: Weather and swings in gas prices seemed to impact store traffic to malls (KSS, DDS, JCP, LTD, GPS, ANF, AEO) and supercenters (WMT, COST TGT), but economists think consumer confidence on the high end (TIF, RL, SKS, COH, BBBY) just might be on the rise. Also, with online sales de-emphasized in the weekly chain store reports - Internet whiz kids Macy's (M) and Urban Outfitters (URBN) could still outperform even if mall parking lots aren't packed.

    The March report on retail sales indicates a measurable impact was felt by retailers from the round of cooler weather seen in the U.S. during the month right along with broader macroeconomic factors. Department store (KSS, JWN, DDS, SKS, SHLD) and home garden (HD, LOW) sales tipped to the weaker side while online sales showed some strength.

    Though revenue and profit at J.C. Penney has fallen off sharply amid dysfunction, at the end of the day the company is still a +$12B retail giant with over 1K stores. This indicates if a Sears-type cost-cutting plan is implemented, at least a few department store chains could see even more benefits as JCP refugees head their way. The likeliest suspects: Macy's (M), T.J. Maxx (TJX), Gap (GPS), Kohl's (KSS).

    Department store stocks (M, SKS, SHLD, KSS, DDS) are trading lower in the wake of the divorce of Ron Johnson from J.C. Penney and a report on retail chain store sales that leaned to the soft side. It's a move that some analysts see as slightly curious with the weather-related delay to the spring selling season only a temporary bump and with J.C. Penney seemingly a punch or two away from a knockout that could bleed some sales to peers.
