VMC shares ended yesterday at $46.21, still 5.6% above MLM's takeover price; the premium indicates some investors are anticipating MLM will return with a higher bid now that the May injunction is over.

Vulcan Materials (VMC -6.3%) shares slip, erasing some of last week's gains from optimism that Martin Marietta's (MLM -3.5%) stalled bid for the rival construction materials company could restart following the expiration of a four-month injunction. Without definitive news, the deal is "an open question," a SunTrust analyst says; it’s "a long time to be engaged in a hostile bid."

Shares of Vulcan Materials (VMC +9.8%) and Martin Marietta (MLM +3.9%) soar, as rumors of a hostile takeover are seen as less likely to come to fruition since business has improved at VMC. Susquehanna says MLM would have to raise any bid above the prior 0.5 exchange ratio, and a takeover would face antitrust risk due to an overlapping market.
