Friday, June 14, 10:09 AM Myriad Genetics (MYGN -7.1%) slumps and is now off ~22% since intraday highs hit Thursday after the Supreme Court's ruling on gene patents. Investors' fears that methods outside of MYGN's cDNA synthetics can be used to analyze genes were seemingly confirmed when Quest Diagnostics' (DGX +0.7%) director of media relations said the company plans "to validate and offer a BRCA1 and BRCA2 test service to physicians and patients later this year" (more). "The focus now shifts to the competitive dynamic," Jefferies says, reiterating a Hold rating. Meanwhile, BofA and RBC cut the shares to Neutral and Sector Perform respectively. (previous) Comment! Thursday, June 13, 6:03 PM Shares of Myriad Genetics (MYGN -5.6%) did an abrupt about-face late in the day, finishing lower after hovering solidly in the green for most of the day. A couple reasons for the slide: Leerink Swann cut the shares to Market Perform, saying that its near-term reimbursement and SCOTUS-specific overhang thesis has played out, and long-term pricing and competitive concerns mean there's nowhere for the stock to go from here but down. Additionally, DNATraits, part of Houston-based Gene By Gene, said it would offer BRCA gene testing in the U.S. for $995 - less than a third of the current price. Comment! [Healthcare, On the Move]
Thursday, June 13, 1:36 PM Today's Supreme Court ruling did indeed deal a blow to Myriad's (MYGN +7.8%) claim to have right to be the sole user of the BRCA1 and BRCA2 genes, mutations in which show a high risk for breast and ovarian cancer. However, the court was very careful to narrow its decision not to rule on any applications of what MYGN had learned about the two cancer-suggesting genes. Nor did it limit any right to a patent on MYGN's methods for manipulating the genes, for which some are viewing today's decision as a partial victory for the company. 1 Comment [Healthcare, On the Move]
Thursday, June 13, 11:49 AM The Supreme Court's ruling on Myriad Genetics (MYGN +10.4%) today is another shot across the bow of the U.S. Patent Trademark Office. The court in recent years has sought to constrict the scope of patent protections, citing concern that they were being issued too easily and so broadly that they were squelching competition and impeding innovation.
