    Ever-litigious Oracle (ORCL) plans to fight yesterday's unfavorable ruling in a suit against SAP over the latter's TomorrowNow subsidiary. It also plans to continue a suit against Rimini Street, a company that, like TomorrowNow, provides cheap support services for enterprise software, and can thereby undercut Oracle's lucrative services business.

    Salesforce.com (CRM), which has made its name selling cloud-based CRM software, is now making a serious push into the ERP software space: Salesforce is announcing a partnership with Infor, the world's #3 ERP vendor behind SAP and ORCL, and also making an investment in the company. (previously)

    A U.S. Judge overturns Oracle's (ORCL) verdict against SAP, saying the $1.3B in damages is "grossly excessive." She says the maximum actual damages proved is just $272M.

    IBM is acquiring Algorithmics, a provider of risk analytics software for financial services firms, for $387M in cash. Yesterday, the company announced the acquisition of security analytics software firm I2. IBM's analytics sales were up 25% Y/Y in the first half, and appears driven to continue this momentum as it fends off competition from SAP and SAS.

    Despite doom and gloom about a looming economic slowdown, SAP (SAP) co-CEO Jim Hagemann Snabe says confidence among clients doesn't reflect these fears. He reiterates that SAP expects to reach the higher end of its 2011 growth target range of 10-14% for software and services.

    SAP, which recently raised its 2011 guidance, is seeing strong demand for its Hana software for analyzing real-time business data. Hana allows SAP to profit from the much-hyped "big data" trend, and gives it a means of competing with ORCL and IBM's integrated hardware/software offerings; the latter reported strong analytics sales during its Q2 CC.

    SAP, which surged yesterday after issuing positive 2011 guidance, may have taken application software market share from archrival Oracle (ORCL) for the first time in 7 quarters, according to Matrix Research's Rajeev Bahl. Bahl estimates SAP's organic Q2 application license growth was 18%, compared with Oracle's 16.

    Business software giant SAP is up 6.9% after announcing its 2011 operating profit will be at the high end of its guidance range of €4.45B-€4.65B. In addition, software and software-related services revenue growth is expected to be at the high end of its guidance range of 10-14%. (PR)

    SAP (SAP) will today ask a judge to slash or even dismiss a $1.3B payment a jury said it must make to Oracle (ORCL) for wrongfully downloading millions of Oracle's files. SAP says its should pay no more than $40M; Oracle is predictably happy with the award.
