    Headed down in heavy volume is Sirius XM (SIRI -2.7%) after it says it will hold the line on prices for its radio service and other packages, including Internet streaming, through Dec. 31 as part of settling a customer lawsuit.

    Howard Stern's lawsuit is the last thing Sirius XM Radio (SIRI -3.8%) needs, so Wunderlich Securities cuts its rating to Hold from Buy and reduces its target price to $1.65 from $2, asserting that “SIRI’s current stock market valuation likely cannot accommodate the uncertainty engendered by the suit - even if it ends up being meritless."

    Shock jock Howard Stern sues his employer, Sirius XM Radio (SIRI), over allegedly failing to pay stock bonuses due for exceeding subscriber targets. The suit claims that Stern's 2006 signing helped Sirius exceed targets by at least 2M subscribers in each year of his contract, triggering a new stock award each time. SIRI -2.6% AH.

    Despite Sirius XM Radio's (SIRI -8.2%) Q4 loss, with rebounding auto sales and a strengthening economy, some say it's still positioned for growth. VFC's Stock House reminds investors that money spent paying down the debt will hold down quarterly numbers for a while, and Jon Friedman and Albert Babayev warn that Sirius must now beat back the challenge from Pandora.

    As online radio service Pandora weighs an IPO, Sirius XM (SIRI +3.2%) is faced with a stronger competitor, Spencer Osborne says. Pandora does not yet offer live content, but that barrier that can be remedied with the plentiful capital raised from an IPO. But Osborne believes Sirius boasts substantial presence, great cash flow and the resources needed to fend off Pandora.

    ESPN (DIS) and the NFL have reportedly agreed to extend their media rights deal, with ESPN ponying up an incredible $1.8-1.9B/year - a 65-70% jump from what it currently pays - not including playoff games. Down the road, this will mean higher cable fees, even more expensive game tickets, and supersonic salary increases.

    Lackluster trading continues, though the S&P 500 and Nasdaq are holding fractional gains (the Dow, at -0.1%, has yet to join them). Conglomerates, tech and transportation have joined financials in positive ground, and most actives include Cisco Systems (CSCO +2.4%), Sirius XM (SIRI -3.1%) and DryShips (DRYS -6.2%).
