- Friday, December 7, 2012, 4:41 AM The Supreme Court could say today whether it will review a case involving a "pay for delay" agreement in which a pharmaceutical company pays generic rivals tens of millions of dollars to hold off from launching copycat versions of medicines. The FTC says the practice costs customers $3.5B a year, while drug firms argue that it protects innovation. - Tuesday, December 4, 2012, 10:11 AM The patent cliff has been good for generic-drugs companies this year, with over 40 brand-name treatments with $35B of annual sales losing their IP protection. However, the sector faces its own patent cliff over the next couple of years, due to fewer drugs losing that protection. - Wednesday, November 28, 2012, 4:47 PM Rexahn Pharmaceuticals (RNN) says it intends to offer shares of its common stock and warrants in an underwritten public offering. The shares are being offered as units, with no amount given at present. Earlier today the company announced it would be receiving additional funding from Teva Pharmaceutical (TEVA) for the development of its potential tumor treatment RX-3117. - Wednesday, November 28, 2012, 12:53 PM Rexahn Pharmaceuticals (RNN +9%) trades higher after the company said that Teva Pharmaceutical (TEVA -0.6%) will provide an additional $750K in funding to the company. Pursuant to the terms of an earlier agreementl, TEVA will purchase RNN's common stock at 120% of its closing price on the last trading day preceding the closing. - Tuesday, November 27, 2012, 3:00 PM Teva Pharmaceuticals (TEVA +0.9%) agrees to delay the introduction of generic versions of two Gilead (GILD -0.9%) HIV drugs, Truvada and Viread, until June 1 or until a judge rules on the patent fight between the two companies. GILD sued TEVA in 2008 and again in 2010, claiming its FDA applications to make HIV drugs infringed four of its patents.
