Biotech ETFs are near all-time highs despite overall market weakness, due to successful trials - e.g. for Vertex's (VRTX) cystic fibrosis treatment - and because some investors are betting on deals occurring. One ETF that is doing particularly well this year is iShares Nasdaq Biotech (IBB). Others include XBI, FBT and BBH.

Shares of Anthera Pharmaceuticals (ANTH -52.1%) can't stop the freefall that was triggered by Friday's announcement that it's canceling its late-stage trial of its experimental treatment for heart disease. Dendreon (DNDN -67.4%) takes down an entire industry, with the Amex Biotech index falling an astonishing 10.4%. "Biotech risk takers burned on this one might be less risk tolerant going forward," one analyst explains. "The biotech group does work like that, especially for product failures." IBB -7.9%. Sanofi (SNY) extends its offer for the outstanding shares of Genzyme (GENZ) to April 1 from March 16. Meanwhile, other biotech firms focused on rare diseases say the Sanofi-Genzyme deal puts many peers into play as takeover targets.

In a major policy reversal, the DoJ filed an amicus brief late yesterday saying human DNA and other genes shouldn't be eligible for patents. It's unclear whether the Patent Office will adopt the position, which could potentially force some biotech firms to change the way they develop drugs. Comment!
