    More on Zale's (ZLC +6.6%) FQ2: The company backs its previous forecast that it will return to profitability for FY13 after its holiday season came in stronger than expected. Same-store sales were up 2.8% during the period. On the earnings call (webcast, slides), execs note the retailer boosted profitability by lowering interest expenses. For the current month, they warn February sales started off slowly before picking up around Valentine's day.

    The National Retail Federation forecasts 2013 retail sales will increase at a rate of 3.4%, lower than the 4.2% rise seen in 2012. Consumer attitudes will be influenced by higher payroll taxes and the ongoing fiscal cliff drama before improving in the second half of the year, according to the trade group. Retailers with strong online businesses should be able to ride out the moderate growth period adequately with online sales forecast to rise between 9% and 12% for the year.

    A federal judge rules Zale (ZLC) can continue to use advertising that claims its diamonds are the brightest in the world in advance of a trial on the issue. The case against Zale was brought by Sterling Jewelers, a unit of Signet (SIG).

    Shares of Harry Winston Diamond (HWD) move up 8.9% premarket to $15.75 after Swatch Group agrees to buy the brand from HW Holdings. The move by Swatch into North America will give Tiffany (TIF), Zale (ZLC), and Signet (SIG) another rival to worry about with Swatch gaining a reliable source for diamonds for its watch business.

    Zale (ZLC) reports sales at comparable stores rose 2.3% during the holiday period while total revenue increased by less than 1% Y/Y to $567M. For FQ2, the company expects a gross margin rate of 50.5% and an operating margin of 7.5%. On its outlook for FY13, Zale will only say that it expects to achieve positive net income.

    A federal judge will rule next week on if Zales (ZLC +4.5%) can claim its diamonds are the brightest in the world. The issue cropped up after a number of rivals filed a lawsuit against the company asking for a preliminary injunction to cut short advertising campaigns for the gems. A point in favor for Zales is that, for the most part, brightness is in the eye of the beholder and hard to quantify.

    Deloitte retail analyst Alison Paul doesn't think the Hurricane Sandy excuse being trotted out by major retailers is too far off base. After accounting for a significant pre-storm slowdown and major power outages in the Northeast, she thinks the numbers as a whole are actually quite good. In that same vein, other analysts point to layaway sales and online sales yet to ship as two categories that will help December compensate for the light November.

    Zale's (ZLC -4.4%) moves lower with the retailer's earnings miss from earlier this week still tipping sentiment. In an earnings conference call, execs blamed part of the decline in same-store sales growth on higher employee benefit costs and the impact of Hurricane Sandy, but the slide in shares this week suggests traders aren't buying that entirely.
