  • Questcor falls; Citron claims Acthar at risk of being pulled [View news story]
Your statement is full of inaccuracies. It doesn't cost $23,500/shot but $23,500/vial (closer to $30,000/vial now) which is a very different thing. Further, the only one who is claiming that it is contaminated or misrepresented is Citron who didn't release the lab report or who did it or the chain of custody. Hence, there is no way for you to know whether it was filled with "other stuff" and the FDA doesn't definitely think so given that they have effectively ignored the Citron report. Further, all batches are independently and externally tested by a different firm (CSL Behring I think) so anything odd would have been picked up ages ago.

It would be best if you could stick to actual facts.

The $100 you received as a premium was not yours before the trade so you are still only posting $100 of your original money. Further, my broker, like most, requires me to put much less than the full $100 of my own money unless the stock crashes much more (of course, it would be very imprudent not to have the full $100 ready if needed).

Incidentally, I have taken on that trade - short a lot of $2 Jan puts but at a premium of only 0.75-0.80. It is obviously down a bit now but I think it is a good longer term trade from a risk/reward POV. It is, of course, with money I can afford to lose (as is my older trade of short $3 puts which is obviously even more underwater now but with which I am satisfied for the longer haul).

Why would any broker ask you to put up $200 unless you include the $100 premium you received since no more is at risk?? The return if it trades at $2 or higher is 100%, not 50%.

It would be great if both of you kept it civil as the discussion is fascinating. I am also not a bio scientist of any type but it would seem to me that, if Citron's lab report is correct, that Acthar is partially deamidated ACTH (Asp in position 25 but Glu in position 30) which would seem to resolve a lot of the issues as their 8-k would still be technically correct and their product will be different from Sigma-Aldrich's and not only because the latter is in powder form unfit for human use. Further, the activity of partially deamidated ACTH has probably not been studied in the literature so that extrapolating it from DACTH could be highly misleading. As I understand it, this should be done by bioassay in any case.

This reminds me of Charlie Munger's advice which Questcor should have taken : Don't wrestle with a pig as both of you will get dirty but the pig will enjoy it.

The NDA only states that Acthar gel is a preparation of ACTH, not ACTH itself and then goes on to state the (possibly incorrect) formula for ACTH.

This is non-trivial as the NDA takes pains to distinguish Acthar gel and ACTH. For eg., "ACTH rapidly disappears from the circulation following its intravenous administration; in people, the plasma half-life is about 15 minutes. The pharmacokinetics of H.P. Acthar Gel have not been adequately characterized."

I am not sure but will be surprised if the 8-k is a relevant document to the FDA. The NDA and the manufacturing process (which has been approved by the FDA) should be what is relevant to that organization. One should also keep in mind that, as with most decent pharmaceutical companies, external QC is regularly done (in this case, by CSL Behring).

Still sounds to me like at most a minor labeling change of type 4 as listed in section X.D of pg 30 of the document.

  • Berkshire board fends off dividend proposal [View news story]
Why would you sell when it it obviously undervalued? Isn't not doing that the essence of Buffett's philosophy?

Further, the dividends make no sense whatsoever from a tax perspective. It is good to see that my faith in Buffett has been well rewarded. I unfortunately doubted his rationality and sold about 10% of my position before earnings as I thought that he may institute a dividend after failing the five year test. I am not making that mistake again and will definitely vote against this irrational and wealth-destroying proposal.

Citron did take such a position on Tesla! You can check it out on their website. Too bad you don't usually hear much about their mistakes like TSLA or QIHU (which, if anyone remembers, was supposed to be a complete and utter fraud).
