    To a very limited extent. As a matter of law, the Judge could reverse the jury but it is very, very rare. The upper Courts will also scold a Judge for overturning a jury especially as it pertains the evidentiary matters. So your comment that a judge can overturn is really what you would see on TV and gives false hope to AAPL shorts like yourself.

    Thanks for the insight. I admittedly got lucky buying some calls into earnings and am certainly looking forward to a nice pop. However, now after reading your article and digging into CSCO more, I am going to go ahead and exercise and go long. Dividend is appealing and I'm impressed with company performance. Also saw that Goldman and Jefferies got very positive last week and I can see more analysts to follow. I can also see more investors coming in now with more dividend protection which will make them more comfortable especially now that treasuries are starting to get nailed. Great move by management.

    Excellent research by the author. Although I am an AAPL bull, this article has certainly got me checking my conviction especially as it pertains to the short term. With the rally today - I'm going longer on my calls and avoiding expiration until Jan 2013 on strike.

    Got me a little nervous now as it pertains to some of the other suppliers as well (CRUS). Hopefully CRUS will give us some guidance on its conference call this afternoon.

    Don't sweat the other AAPL bull making derogatory comment toward you. I love AAPL as much as the next guy but I certainly try to leave my blinders at home.

    Appreciate the article. Also see valid points from saratogahawk. My opinion is that you can't go wrong with either. If Devon continues to evolve into more liquids (EOG style) I like its growth potential and they certainly have the cash for capex. APA also has great assets and I am looking forward to hearing more about them pushing on the Kitimat LNG facility and build out on its recent ginormous NG find. Little disappointed that they have pushed it out another year though.

    Hey - big points for side by side comparison with your stats. Very well done!

    I have been itching to come back into this name in addition to EOG. I am now going to look to take a position with reborn confidence thanks to your analysis.

    I also really love that cash they have on hand and they could become the next generation early mover (like EOG) in the shale plays if they are smart with greenfield acquisition. There has got to be another Eagleford out there!

    I admit I am a crazy bull on AAPL which has served me well (as I am sure you). However, I must say that this articles is very interesting and for once, after AAPL gets hit as it had a below expectation quarter, someone offers come insight questioning AAPL rather then just piling on by offering stupid correlation (like comparing AAPL and XOM).

    So lets see. Author is long VVUS and ARNA and he probably bought in at a stupid level and he can't stand retail money going anywhere else but into his play(s).

    I can guarantee he got stung and now he makes that huge correlation (please note the sarcasm) between the action in those over bought stories by applying to this one (which has been consolidating for the last month).

    ARNA and VVUS ran up stupid. AMRN is next so of course it will do the same. Sigh. Yawn. Do you have any real insight?

    I also agree that this stock is a keeper but boy, it has been painful since earnings. Also, Abraxine provided great results as it pertains to pancreatic cancer at the conference a couple of weeks but it got no legs from that which is very dissapointing. Other results for Abraxine were considered dissapointing as to large cell lung cancer in terms of the effects of its generic substitute.

    Hopefully, the next catalyst will be European approval for Revlimid as a first line defense. I think buyers will come back at that point. I'm sitting on a good number of Jan 13 calls but the price acton on this stock is stinky. I just can't sell though. Look at that PEG ratio!

    What's worse about this is that this appears to be a time that retail investors finally got involved. Now, they are going to get reamed on this and it does nothing more than reinforce retail investor skepticism that wall street is nothing but a scam job. Not to mention AAPL's downfall and its effect on the retail investor.

    Much more, NDQ really screwed the pooch on this one it terms of execution. This does nothing but keep more people on the sideline.

    CNBC as well as the media should be ashamed of itself. All you see or hear for the past months has been the hype. Now all those poor souls who bought today (especially the retail investors) are going to get nailed Monday as no more underwriter support for the IPO price.

    CNBC is a disease to the market. Consider those morons on Fast Money who are there for one reason: to hype trades that they are sitting on for the next day in order to get a "sucker pop".

    I third all of that. Also, one aspect really irritates me and I agree may lead to the downfall of the "moron" carriers. One of my best friends works for AT&T Wireless and he admitted to me that management there is pushing the android over the I-Phone. It irritates the heck out of him because a)the churn on the I-Phone is much less and b) there are not nearly as many repair/software problems with the I-Phone compared to Android garbage. He is mid-level managment and he is continually frustrated because upper managment is pushing for android due to better topline numbers but they forget about the fact that the backend savings on the I-Phone is considerable. However, the better product will prevail and kudos for your girlfriend by sticking to her guns rather that go with T's motives of steering clients to droid crap.

    This stock is about catch-up. The bears want to corner it as a pure momentum play as they stare that the cute little charts without taking into consideration a very important concept.
