  • A Major Victory For Linn Energy [View article]
    Not having seen an answer to several legal questions, here's what "with prejudice" means. It means the case is over and can't be amended. It can, however, be appealed. This was pre-trial meaning Summary Judgment. That means given the facts that are not in dispute, there is no legal merit to the claims. Summary Judgment is a pre-cursor to a Motion for Attorneys fees for a baseless case. There may be a basis for filing such a motion but it is a separate and oftentimes expensive motion. Not knowing how much was spent on defense, it would be hard, at this stage, to decide whether to do so. As far as being greatly favorable to Line, I agree, it is best. I wrote last year that this was an oil and gas company doing O&G things brilliantly. I still have my Line at 37--not back yet--but selling puts at 25 and 27 and calls at 35 made up the difference. Also, Year 46 in civil litigation in October. So I think I know what is up here.

    Actually, I am long the stock and long call options going in to the vote. This is an oil and gas company that will have its ups and downs, but, its potential, viewed as a wild cat play is unbelievable and viewed as a development play is solid. If the shorts aren't out now, they will be in two weeks or they are stupid.

    As I am intimately familiar with O&G class action litigation from a historical and on hands point of view, and as I said earlier last month, I am long LINE and BRY for the long haul and the people who joined the "Class" are suckers and Counsel who have started these cases will be rewarded with NADA, in my opinion based on 45 years in the legal biz. But maybe there is something these guys know that they haven't disclosed. Wouldn't that be interesting?

    This article is "highly" charged with comments like "highly controversial". Sounds like a bear raider shill. It states "most important metric" being DCF. Excuse me. In an O&G enterprise, the most important metric is its success at finding (or buying) and selling oil & gas or its constituents. Sounds like a plant to me. Not an O&G investor.

    These points are are well taken and have a logical base. However, this is an oil and gas company, not a utility. Utilitie distributables go down when the interest rate goes up because the constant is the user base. An O&G company distributable goes down when its income goes down due to bad asset choices, the O&G market (apropos here), the high cost of acquisitions, wells that blow up in the deep. Not brain damage. So what? This is a company that has substantial assets on shore and someone investing in it should be in for the long haul and count on the imagination of its officers. If they fail, dump it. If they succeed, you've made a good choice.

    I read these comments with interest because they all raise good points. 40 years ago I was asked by a Federal Judge to help keep a Exploratory oil company going that was subject to an SEC investigation and a Class Action. Ever hear of John King in Colorado? Anyway, it kept going and one day hit a huge field. Line is a thousand times bigger than the one I was involved with and it has actual assets in its pocket. It is not a development O&G issue, it is a Wild Cater hoping to go development. Big Rewards, Big Losses. The Bear Baiters love to kill the Goose with dippie articles from Barrons. It's still a throw of the dice and I'm in for the long term. I believe in Oil Companies-and especially-- in this day and age. Remember 20 years ago and 10 buck oil? Another 40 years, I won't care.

    we have been long LIne and Linco quite awhile. Linco got called at 40. Last Friday I bought BRY due to the arbitrage. This is a deal made in good places. It is no Ponzi. I have reped Ponzi types. It is real. I believe because i read. I also believe JC. If we are wrong and the bear raid is successful, we need legis. I go with Cooperman.

    I agree with DAG1996. Long at 16.51 and short Jan 20 Puts. If GE breaks through 21 in a meaningful way, it could easily get through 22 by late fall. GE is the real deal. Guess the director thought so too.
