    The key to the Court's action does not seem to be the removing of the presumption of prudence; it is, instead, a reemphasis on potential liability "when companies fail to take action to prevent stock losses in the employees' plan where there is fraud or other misconduct at the company that leads to a significant drop in the stock."

    In my opinion, the recent experience of the GULF etf and that region's banks is more reflective of investor jitters than fundamental weakness. Unrest in Egypt, Iraq, Iran, Israel, Libya, Palestine, Syria, Turkey, and the Ukraine generates understandable concern and especially fear of disruption in energy processing and shipping. As tension dissipates, Gulf commerce will flourish again -- as it has been doing in spite of regional volatility for hundreds of years.

    Your take seems to be that because things haven't changed, then they won't. Combining this shallow thought with a snide style leads to an unsurprisingly bleak outlook and some weak writing,

    "The first 30 or so pages of the report elicit a heavy sigh."

    "While the basis of the study is well-worn territory, the authors do eventually move into solutions, which are centered on government action (with a side order of energy efficiency)."

    "The report is Pollyannaish in its suggestions, because, realistically, these changes to government policy have been kicked around for the past few years, and in some cases decades, with little to no movement."

    Much more helpful would have been your taking a position and helping the reader appreciate what could be gained through changes in energy and taxation policies, what valuable qualities or balances might be negatively affected in the process, and what stands in the way of exerting the political will to make valuable changes.

    I appreciate your acknowledging that Apple will continue to be in good shape, but I take issue with your title. The EU is investigating countries that appear to be charging unfairly low taxes -- Apple is mentioned only because it pays a 2% tax in Ireland.

    I share your sense that it is important to look objectively at reasons for encouragement and optimism in investing while also acknowledging that U.S. and other economies perform less well than they could. Television and radio programs and simplistic media reporting pander with streams of second-guessing and contempt for government figures, programs, initiatives, and future prospects. On Seeking Alpha, the strongest attacks typically come without constructive criticism or explanation and support for programs or stances that would be superior to those that are criticized. Contempt is easy and obscures, I think, one's capacity to assess how things really are.
