    You make some good points, and...
    The real-estate bubble was not necessarily created due to "no shorts on real estate" but like any other bubble out of greed of humanity.
    And as greed grows, since the 80's yuppies, so do the bubbles come more frequently.
    How come the shorts didn't stop the internet bubble? you could short it, no?
    and... by the way, Credit Defaults is a long which could short the Real Estate bubble. and did. You would have gotten a nice slice of the TARP money.

    and these days, don't we have a Fed Bond bubble - 10yr notes for under expected ave inflation? if this is not a bubble then what is? and.. you can short these notes DTYS or something, and yet, there IS a bubble.
    You think it's a bubble, stay out. Let the bubblers take the mhit, without adding to their hit by taking a slice yourself. When you short a bubble you don't stop it you just take a byte from these poor people
    on their way to bigger losses. You justify ripping them off by telling yourself you'll stop it. You are just greedy making money on their stupidity that's all.
    This is NOT economics, it's not job creation, it's GREED.The shorts on a bubble make the bubble worse (they take profits where the overall picture is of big losses, how does that help them...?

    You worry about stocks being too expansive? what about cars? food? gas?
    Market checks and balances work there. Supply and demand. without shorts, amazing isn't it.
    There is enough competition, enough stock selection to keep prices in check (assuming no excessive pumping of new money)

    The mechanism of shorts allows banks to print money. They are the main share lenders. I short a share, suddenly I have more money to invest, and yet this money is still on the books of the bank? nice no?

    You and I can print money now. nice. I like this part.

    But, my point is the FTC and SEC will NEVER catch this current Einhorn/Ackman/Mr X scheme, not because they can't but because they are buddies.
    You what really really stinks here?
    That Ackman did his shorts on Einhorn's signal. Did Ackman do his "research" before or after Einhorn's Q's? mmm...
    How come HLF dropped BEFORE Ackman's announcement of his presentation? not before the presentation, before announcing the presentation.
    Why did Ackman do his presentation 1 day before futures expiration and 1 day before a long weekend. Nice timing for making a "legitimate, fundamental argument"
    of course, to save america from the crooks.

    This is just bits of the flip side of shorts.
    and it is bigger than you imagine, with Congressmen, and inside info and all the other reasons behind the 99% movement and discussed all this already in detail. These are not dirty-hippies. there were many people there who are much smarter than Einhorn/Ackman and Uncle Ben, much more honest and much more patriotic

    Shorts are THE hot-bed for corruption and may serve a smaller role in the checks-n-balances that you find in them.

    It's a very bad idea to let someone with such a big ego manage your retirement.
    I do question his motivation and sense on JCP, Borders etc.

    These are the types of shmanalysts which have never been to the businesses they own. Driven by the need to be "special" and win hopeless bets.
    That's how you are recognized among the 1000's of hedge funds. Win a crazy bet that everyone will talk about.
    It's good for raising money for your 2/20... but very bad for returns.

    But the part that's really worrisome for the investor is this.
    Ackman is $1B ahead, faces some headwinds and sticks to his position "until the end". He threw away 1/2 of it already, and losing more every day
    THAT'S EGO RUNNING WILD
    That's against Investing 101
    That's having no stops on your investment
    That's promising to go down with the ship if and when
    Why? Why would you want to be on this ship?
    When he says "I am doing this for America" that's a borderline trip already.
    This has hints of Megalomania
    That's when his own family should tell him "Dad, we have everything we need, please stop, we don't want to risk being homeless"

    Do you really want to put your retirement money with this guy? really?
    You can't find anywhere better?
    Main, KKR, Brk.A... or really ANYTHING?
    VIG (which my grandma owns) should do better.

    Truly, i don't expect much support HERE for banning shorts
    Among the crowd that got used to making money on trading.
    I come from a different angle...
    why do we have a stock market? what's the purpose?
    from the business point of view, job creation, retirement security... from any of these angles - I don't see the why allow shorts.
    The only reason are the traders which want another avenue for making money for themselves.
    Cool but not at the price of what Wall St is doing through shorts.

    It's a Buffet rule, invest in businesses you know and love/appreciate through your daily life
    KSS stores are a desert just like Sears, JCP, Borders. I don't really know if KSS will be around 10 years from now,
    and like Buffet says: if you are not willing to hold a stock for 10 years, don't hold it for 10 minutes.

    Thanks. what can I say...
    I have 1 question which has been bothering me over the history of ZIV XIV
    During the last week of July 2011 and into Aug 2012, these 2 funds lost value which took a ~year to recover.
    What happened there? and I don't mean "macro-global", but rather on the technical level.
    An unusual backwardation? if yes? how strong was it?
    On what date did the Vix go into backwardation?
    Was it possible to call this situation ahead of time, or at least early enough...
    Have you done any research on returns, where at the 1st moment of backwardation you sell all XIV ZIV...
    Any other money management tips?

    A point which is not much discussed here...
    MLMs are a threat to CNBC/MSNBC/Bloomberg because they replace the expansive TV ad's with network marketing.
    I wasn't surprised AT ALL when Ackman got such free prime-time support for his short-manipulation-sch... I do have some opinions too, and I am much smarter than Ackman, and I don't get even 2 seconds on these networks to push my portfolio's agenda

    Here is my research (everything is "research" these days) on Ackman.
    Once I went into JCP (needed to go to the bathroom). I couldn't believe how empty, deserted, end-of-the-world the place looked.
    Just looked around and wondered how they pay the rent and the interest on the massive inventory. Forget the sales people (actually, there weren't any around...)
    And this guy calles HLF the easiest short of his life and goes long on JCP AND Borders?
    The FTC/SEC should take his license-to-destroy others' wealth
    Ackman didn't just make a mistake here. The guy is a clueless Wall St type which buries his nose in fancy theories, and spends on his hair more than my whole budget (hey man, trim these eye-brows a bit).
    Maybe he should spend a day in the Mall instead(?)
    Some Wall St guys have never had a real job in their lives, and maybe they should, before wasting billions of hard-earned-savings $s on the stupidest ideas.
    There is a ring of shortists in Wall St who get a very unfair advantage, and still cannot beat the basic index ETFs, even before their 2/20

    If we/SEC(?) dug 1/2 as deep into Ackman we will find 10 times the trash.

    There sure is more to Ackmen's agenda...
    Ackman also fails to research/mention how many investigations were started and came up empty in the 80 countries (incl 2 investigations in the US), and mentions only 1 judge in Belgium. This would hardly be considered "good faith" "research"

    Just on this point, I would really suspect Ackman's agenda

    Here is a shorter and simpler language explanation

    Let's say I want to use HLF

    I can buy from my sister (a real distributor) for full price
    or
    become a distributor myself and get 25% off

    29% of the distributors are like me. They registered as distributors just for the discount. They are actually consumers. Economically and logically these are consumers.
    The FTC actually missed that point, made a boo-boo in their definition. This is really what the writer implies.

    According to Ackman I (and the other 29%) are not a retail consumer

    According to the writer I SHOULD be considered a retail consumer (and maybe called "prefer customer" which would make the whole pyramid argument collapse)

    yes? understand now?

    The part that makes me real worried is the incompetence of the FTC...
