  • Analysis Of Oral Argument In Vringo Vs. Google Patent Infringement Appeal [View article]
I would not put much faith in Rach.. As an attorney, he has made some real bad predictions. Like the one article that said VHC would get an injunction on apple. Any attorney knows that first of all, it is nearly impossible to get an injuction and it is impossible when you don't sell any product. Secondly, he was wrong about this one as well.

I've been a strong and vocal about Rachiver's historic predictions based on legal opinion. I'm certain he is wrong more than he is right.

Like I said before, my impression is that Rach. is NOT a very good attorney! He wrote an SA article back a while ago on why he though VHC would be victorious on getting an injunction on Appl. Any attorney should have known the odds were very lite because VHC wasn't selling a product and therefore, Apples infringement wasn't affecting their sales. I personally think he was setting up people on a pump and dump. Personal opinion.

Personally, the PTAB should only be used by an "accused infringer" not anyone and everybody who wants to file one. Maybe we ought to load up the courts with frivilous filings for PTAB and see what they do. After a couple thousand filings, they will find that they should not award these to just everyone.

Now that is a bunch of bunk. You might want to do some DD and then come back and give some meaningful responses. I think you could do it if you put your mind to it.

    Dan,

Considering the amount of money that even a 0.25% Royalty Rate generates for VHC, do you think Apple will take a roll with the dice of chance? Personally, as pure business decision, I think it is not worth the risk and a deal will be made. Either reducing the royalty rate, a buyout, or a lump sum payment. What are your thoughts? I don't think we will make it to the ruling personally.

HUGE difference between VHC case vs Mirror case. In VHC, Judge Davis already denied Apples retrial motion as well as upheld the jury verdict. The reasoning was well written by Judge Davis. You may want to actually read it.

Exactly why Apple will either BUY or settle with VHC. Less than 13% chance of overturning a jury verdict. Plus, nothing new was asked in this appeal, same old questions that Judge Davis answered thoroughly.

"Apple didn't present an alternative calculation for the iOS products". I think Apple just shot themselves in the foot with the Samsung case. They are actually asking for $8/phone per patent infringement for simple things like "Swiping". Obviously, they are putting more value on their patents vs VHC.

I think the APPLE vs Samsung case where apple is looking for $8 per patent infringement is a good starting point. $8 per phone for SWIPE technology? Then I think a Security Patent is worth a heck of alot more.

Dan, as an attorney, I think you should know that the odds of overturning a jury verdict based on technicalities is still pretty slim. What do you think the odds really are?

So arrogant aren't you? The same Ravicher that said that VHC would likely get an injunction on apples products back on Jan 23, 2013. Hmmm... I've got to wonder if you really are good at what you do. I doubt it.
