Is Herbalife A Pyramid Scheme? ¿Quien Sabe? [View article]
Herbalife is popular in the Latino community BECAUSE they are a sponsor of the most popular sport in the world, Football (soccer), in which the Spanish world community is a major participant. To say that $HLF is preying upon the North American contingent of this demographic is either due to ignorance or due to a desire to purposefully perpetuate a lie. I don't think you are ignorant, Matt.

This guy lost me on the second paragraph, where he made up facts instead of investigating them. "Representing Main Street, a 100-year old consumer protection organization, the National Consumer Protection League, studied the 300-slide presentation published by hedge fund, Pershing Capital Square, and publicly called upon the FTC to investigate Herbalife as a possible pyramid scheme." The fact is that NCPL called on the FTC to distinguish what is truth or fakery on both sides of the argument. Of course if this were to have happened then $HLF stock would have taken a hit. I find it intriguing that after 3 months of this type of vile attack of disinformation that no action has taken place by any regulatory agency.
The only purpose of these Bear Raid attacks on $HLF is to keep the subject alive long enough in the hope that a Government bureaucrat is paying attention and is looking for a way to make his bones. Not likely, as LA and California need all the tax $$$ they can get. There is no reasoning involved in these discussions. It's like watching congress. To agree with the writers claims, even in part, is only feeding their voracious appetite for trying to make a fortune by destroying others livelihood. In fact, those that have come forth in these discussions to give personal experiences contrary to short-sellers "opinion" have been dismissed (and degraded) as being fraudulent. In court they would be referred to as "witnesses". ~ In Chanos' chat with Joe Kernan on CNBC about the subject, Kernan derided the company based on his opinion of health foods and vitamins. Hardly a well versed opinion. Herbalife responded to Kernan and defended their marketing, value, and science. To Joe's credit, he accepted their offer to send him some product, along with research notes, and other pertinent information. Kernan says he's going to try it and see if he loses some weight. So now comes a skeptic who is willing to see for himself what the hubbub is all about. It will be very interesting to see what happens if things turn out on a positive note. Becky Quick is going to give it a shot, too. Finally, honest people looking for truth (I hope).

If a company does not provide a competitive product, it will disappear. $HLF grows quarter after quarter, year after year. Oh, by the way @travlingurl, it's "plain".

Have you ever watched the movie "Back to School"? I think it satirizes the intellectual/experience disconnect spot-on. I would be investigating more prolific game than vitamin salesmen. Easy target, my guess.

You make this sound as though this is a directive against $HLF specifically. Again, you are rehashing yesterday's newspaper. "possible FTC investigation". Possible vote recount electing Romney as President. I find no such directive on the FTC website that connects your quote to an Herbalife investigation. I could be wrong. Give me the link, please.
Herbalife: Putting Bill Ackman's Arguments In Perspective [View article]
Since this debacle began, @hudget, there has been nothing but arrogant speculation guised as irrefutable proof that $HLF is a "scheme". Just as in any philosophical debate, there are many shades and hues of the truth. All of these questions have been answered in one form or another. Ironically, the "Inquisitor-in-Chief", John William Ackman, of Pershing Square fame, has been notoriously silent. He's been too busy in court trying to bail out his $JCP (sinking) ship, as Macy's attorneys keep pounding Bill's golden boy, Ron Johnson, about his Martha Stewart faux pas. Bill actually came up with this scheme to cover his losses in 2012. Pershing Square has become a laughing stock, if you haven't noticed. Take a look at the upcoming Vanity Fair article about Ackman. The General has abandoned his troops and deserted. Still his little minions fight on, not even noticing his absence. The fact is, he is on the precipice of being investigated and sued for stock manipulation. There is such a thing as the spirit of the law. Short sellers are trying to obfuscate the simplicity of of this issue by invoking the letter of the law. So I have some stupid questions. Seeing as how $HLF continues to go up in price (while $JCP tanks), at what point do the shorts capitulate? Do you have skin in the game? Isn't it getting close to where the price was when Ackman started his crusade against protein powder? Why would a man invest a fortune times 10 in a company that is accused of being unsavory? You see, these are the types of questions that count. The other minutia being spewed is quickly becoming non-existent. That's because the loudest have already covered. The only ones left are the pawns left bleeding money on the chess board. Do you play chess?

Another fine rebuttal @Fusion Research! You are correct. There has been irreparable damage done. Just like a man arrested for a robbery when it was a case of mistaken identity. He carries the weight of guilty opinion on his shoulders all his life, UNLESS someone comes forth to vindicate his name. You, in this case, are the hero. I've been fighting to get back to square for some time. Just when I thought the Einhorn thing was over Pershing Square came up. It's not just me, mind you. How many mom's and pop's have their 401k wrapped up? Or pension funds. There are a lot of high-powered brokerage houses involved. Thanks for taking the time to research this. I do believe that when the time is right, $HLF attorneys will extract justice from Mr. Ackman. I can see why it would take 18 months for him to hatch a scam like this.
