This doesn't make sense to me. Counterparty risk in CDS should lower the spread, not increase it, as protection buyers are the ones that lose in counterparty default (they dont get paid) so they won't bid protection as high as without counterparty risk. The difference is due to the difficulty of shorting cash bonds, yes buying cash bonds is a way of getting "shafted" at this point.

very simple guys, volatility rises when prices fall (lots of reasons, google it, for example: corporations get more leveraged as equity values fall relative to debt, this increases risk of bankruptcy)
