sl62- Remember the Shares loaned out for others to short? Either way, Debt holders had it made. BK (or Near Levels) would bring in funds to cover debt. Debt holders would break out of shares if the went over lent value. This was a win - win for them. The Debt holders MADE their money back well before the 2013/2014 timeframe! So why hang on to the Debt any more..sell for a loss.. (.40 -.50 on the dollar) and use GAAP to bring down profits from stock pprofits for a couple of years or so.

Trimming operations was one of Mel's war crys! The removal of the 4 sats that can sell for 300m - 700m was probably in the works all along. IMHO the book cost of the XM sats EXCEED the Debt.

Candy - But the number of shares that you currently have 12,000 @ .06 = $720 + commission. Then Sell the original 12,000 bought @1.29 for a loss. Some of the loss can be taken off your taxes. If the stock goes up, you now have a loss for your taxes to offset any gains that you may get later!

relmor - Item #1 I don't think it's their job to protect. I do think that they should divulge in every article the express nature of the sories are to promote the owner.
Item #2 I did a little research into ownership of WSJ. Guess who....No not GS.. But, the WSJ & New York Post are owned by the same individual. Maybe writers for the two newspapers got their submission confused... then again..maybe not. This man also attempted to focus on building a television-satellite business in Asia by buying a controlling stake in satellite broadcaster Star TV. Wikipedia is also quoted as stating the owner has "expressed his personal, political and business biases through his newspapers and television stations." The owner has benefited from these actions.
Is the possibility of gaining a foothold into the American Satellite market within this mans sights?

So... Can Mel just close the XM doors & file for BK on that business unit? Give replacement receivers in compensation for the XM subscribers and have them jump to the Sirius side of the house?
I wonder exactly how the asset transfer was written during the acquisition. The Sirius side has 174M while the XM side has about 783M. Feb Debt and 1.8M of September is all Sirius.

This directly from the 3rd quarter 10Q statement. : " SIRIUS is the sole stockholder of XM Holdings and its subsidiaries and its business is operated as an unrestricted subsidiary under SIRIUS’ indebtedness.
Under certain circumstances, SIRIUS may be unwilling or unable to contribute or loan XM capital to support its operations.
Similarly, under certain circumstances, XM may be unwilling or unable to contribute or loan SIRIUS capital to support its operations.
To the extent XM’s funds are insufficient to support its business, XM may be required to seek additional financing, which may not be available on favorable terms, or at all.
If XM is unable to secure additional financing it could be forced to seek the protection of the bankruptcy laws. "
It reads as though there is a clause that XM debt is the responsibility of XM and Sirius Holding has no responsibility for the debt. Forcing the subsidary XM into bankruptcy restructuring (Selling off Assets?).
