$199 (for 16GB) is the contract price.
If I am a previous iPhone subscriber, the new-phone upgrade cost is exactly that of a new customer ($199). If i am a non-iPhone subscriber, eligible for upgrade, the cost, again, is $199.
The higher price refers to a non-iPhone subscriber who wishes to break his previous contract to switch phones. If he doesn't like it, he either buys a new line for $199 and keeps his old phone until the old contract is fulfilled, or waits.
