  • Get Ready for the e-Commerce Internet Tax [View article]
The Sales Tax issue has been a sad tease for AMZN shorts and I am not holding my breath for any legislative relief which has been talked about for over a decade. If it ever does come, it will be too late for big-box retail. BestBuy is clearly on the Circuit City road to extinction and WalMart will have to make-do selling low margin groceries and dollar-store merchandise.
The answer is for main st retail and big-box in particular not to wait for the gridlocked govt to come to their rescue, but to adopt the old saw “If you can’t beat them, join them!” and change their tactics. What is stopping big-box retail from adopting the Amazon playbook by reorganizing their online operations with sufficient Entity Isolation voodoo that Amazon has perfected and thus dodge the Nexus issue? With this setup they can even leverage their retail locations for pick-up & returns and Brick & Mortar instead of being an albatross will give them be a competive edge.
Anyway, I think AMZN by them will have milked the fair or unfair competitive edge and will have moved on and morph from a discount online retailer into a cloud infrastucture and cosumer electronics powerhouse with the experience gained from Kindle ..

  • ‘Stuck in the Middle’ Retailers May Soon Face Extinction [View article]
Since Sales Tax Savings drive customers to shop online esp. for the higher priced (and margin) items and because brick & mortar carries the Nexus albatross, customers end up paying sales tax with Best Buy online or off.
Why can't they simply spin-off their online operations with sufficient Entity Isolation voodoo that Amazon has perfected and thus dodge the Nexus issue? With this setup they can even leverage their retail locations for pick-up & returns.
In spite of all the talk of legislative relief to level the playing field for Main St. retail for over a decade now, I am not holding my breath for the status-quo to change anytime soon, or at least not before Best Buy goes the way of Circuit City and WalMart will be reduced to making-do selling groceries and dollar-store merchandise.

  • Why I'm Short Amazon: Waiting for State Governments to Wise Up [View article]
In Texas it took the effrontery of a subsidiary in plain sight flying the Amazon flag in Irving,Tx which brought the hammer down which interestingly the authorities were clueless about up until a journalist from the Dallas Daily News blew the whistle.
Amazon, similarly operates its Lab126 which developed the Kindle smack in middle of Silicon Valley in Cupertino but that was a "never-mind" to Republican Schwarzenegger who thought fit to veto legislative action to force Amazon to collect. So, I can't say if it is a liberal thing which is allowing the loophole to fester and gut main street brick & mortar retailers.
I shop at Amazon and most, but not all of the time, it is the sales-tax savings that had been too much to pass up on and has been the clincher in deciding buy at Amazon rather than the instant-gratification of buying at Best Buy which I otherwise would have.
But it is baffling why others, most notably Wal-Mart which is well known for its bare-knuckled competitive tactics, doesn't adopt the same play-book of a web of subsidiaries to dodge sales tax collection and level the playing field as otherwise all its online initiatives will simply continue to be pathetic.

  • Geron: Buyer Beware [View article]
Checking their financials stats on yahoo shows they have $121MM in cash & no debt. I think GERN's past history of dilution has blemished its image among investors but I feel with the IP portfolio they have built would not have been possible without their incessant tapping of the capital markets in the past. Now with the comfortable cash position and the credibility of their science they may be deserving of redemption one last time.
