  • MLPs - Yes, They're Okay In Your IRA And Other Tax Questions Answered [View article]
    So PHIL,
Did you ever hear of the tax treatment/effects of one transferring a MLP from an IRA to a taxable acct, and then paying ordinary tax? Would seem that, that tax would cover all requirements, just as transferring stocks!
    Thanks

I have, and pay a CPA, and a Broker that serve me well. My point is that, so many on SA offer one line, misleading jabs at interpretations, that I urge them to back up what they say! You have avoided! OK!

When I transfer funds for my RMD, I use both div paying stocks, and sometimes MLPS. The cost resets to the price at time of transfer. I pay Ord Income tax on all. Divs remaining in IRA will ultimately be taxed as Ord income Some say transfer = Sale! OK, do you pay tax for the RMD securities, or in the IRA---surely not twice!
Been posting for some years, and never had anyone state specific chapter and verse. Even RK was not firm on the matter!
Could be if you sold a MLP right after transfer, the tax would be minimum, as would be a Stock.
Any comments should have good documentation?

Don't believe IRA is a partnership! Another one line incorrect comment!

What I "read" yesterday, was not specific, or convincing about the sale of MLPS in an IRA. It was about Partnerships in general. Read that years ago from RK, and he labored to interpret.
My Broker, and CPA agree w/ me!
My motives are to discover accurate information. Report that!

"there are two components to UBTI - the annual amount (reported on the K-1), the UBTI recapture on sale of the units."

Could you please advise exactly where I could find specific details of tax computation of "UBTI recapture on sale of the units in an IRA"?

    Have you ever paid such?

No one has ever come forth and reported such!

My CPA, and Schwab says none on sale!
    Thanks

Read this before. Would you say this IRS reading applies to tax deferred accts on sale, or transfer to Taxable accts? My CPA, and Broker says not!
    Thanks

I have done my research w/ my Broker, and CPA, and they say no UBTI on sale in IRA. I have transferred, over many year, numerous equities, and MLPS from IRA to taxable acct for my RMD, w/o issues.
Sorry you can't backup you "comments".

“If you sell an MLP held in an IRA account you will be responsible for the tax owed only on the portion that is identified as RECAPTURE”.

Can you point exactly written docs that support this? Asked many times, and never got an answer!

    David, ephud,
You guys are lost in the woods! See earlier comments on KMR, EEQ!
No yearly 1099, or K-1, NO UBTI
Each give shares for divs, about 7+%/yr. Good Deal! Price generally follows associated MLP.
No taxes in IRA, pay ltcg on share sale in taxable acct.
KMI, and LNCO gives 1099's tax on yearly divs in taxable acct, not in IRA unless withdrawn.

KMR, and EEQ are excellent, and are 1099's. 7% + divs.
Further, no yearly tax on Divs, only LTCG when sold!
Hold in IRA, or taxable acct---I'm big/long!

" 1) sale of the MLP within the tax deferred account or 2) distribution from the tax deferred account to a taxable account. Both are considered sales for tax purposes and will generate ordinary income from the depreciation recapture"

Can you site chapter and verse backing your statements?

Surely, on transfer from IRA to taxable acct, ordinary income is paid on total, thus covering any/all taxes.

What about divs that remain in IRA when MLP transfer is made?

I posted earlier, stating, after many years of asking by many, no one has posted saying that they paid taxes on SALE in IRA!

Any one out there paid taxes on sale of MLP in IRA????

"Also, if you own the MLP long enough in your taxable account and your basis is 0, then the distributions will be taxed as ordinary income each year."

I don't think this is correct. I have read many times, that when a basis goes to zero, that one pays Long Term Cap Gains on subsequent distributions.

Also, having been a long term investor of MLPS, and listened to RK's gospel on sale in a IRA. The question about Tax handling, on sale in an IRA has been asked to investors on numerous blogs, and No One has ever admitted that they have paid any taxes on an IRA sale. My acct says not, along w/ Chas Schwab.

One more time! Anyone paid taxes on MLP sale in an IRA?

Being concerned about this issue, I have transferred MLPS from IRA to Taxable acct w/o incident--paid ordinary income--but still made some $.
I'm really not concerned any more, and will hold MLPS in my IRA--best divs available. Tax accounting in a taxable acct is somewhat of a nuisance, but doable!
