  • The Justice Department and the Patent Office are against imposing product-sales bans for IP infringements except in very rare cases, the agencies said yesterday. They also appealed to the ITC to give the public interest - i.e. that "exclusion orders are inappropriate" - the top priority when deciding sanctions for patent breaches. The comments come against a background of the global IP war between the top mobile phone players. [View news story]
Right on! Much of what has been pushed by the Obama White House fits this mold. Obamacare is not about healthcare or the costs involved, it is about control. Since parts of it have met resistance it is now important for them to remove private guns, (politicians fear retaliation).

  • Windows 8 (MSFT) receives a big vote of confidence from the DoD, which says it will deploy the OS as part of a massive deal with Microsoft that covers nearly 75% of its ~450K personnel. Many enterprises and institutions have declared themselves uninterested in adopting Win. 8, whose new UI makes many IT departments uneasy. However, some IT security experts have argued the OS' new features, such as Refresh and Secure Boot, will make it more secure than Win. 7. Office 2013 and SharePoint are also covered by the deal. • A July E.U. court ruling sanctioning the re-sale of software licenses could damage the European sales of enterprise software vendors such as Microsoft (MSFT), Oracle (ORCL), and SAP, as cost-sensitive companies opt for second-hand "copies" selling at a 30%-70% discount. Germany's UsedSoft, the winning party in the E.U. ruling, says it has seen demand triple since the decision was made. Most U.S. software contracts forbid the re-sale of licenses. [View news story]

  • Google (GOOG) -0.8% AH in response to Apple's (AAPL) huge patent win over Samsung (SSNLF.PK). The software patents Google acquired via Motorola Mobility, some of which recently became the subject of an ITC suit, are now more important than ever in defending Android. Microsoft (MSFT) has to be pleased with the verdict, given it could boost OEM interest in Windows Phone. [View news story]

  • EMC Corporation: The Time Has Come For This Storage Giant To Pay A Dividend [View article]
If EMC can invest and grow the business, that is a better use of the funds. When a dividend is paid, taxes are due. When the business grows, value goes up. I pay enough taxes now.

  • Though the companies keep saying the right words, Cisco's (CSCO) partnership with EMC is fraying, sources tell Reuters. The companies' VCE JV hasn't turned a profit, and Cisco has reportedly discussed acquiring an EMC storage rival (ed: Are they looking at NetApp? Or a startup such as Nutanix?). EMC, meanwhile, has thought of buying or partnering with a Cisco networking rival Also, Cisco had a $750M deal to acquire startup and long-term threat Nicira, only to see EMC's VMware (VMW) outbid them[View news story]

  • Goldman reiterates its Conviction Buy on SunCoke Energy (SXC) and raises its price target to $21 from $18, while maintaining Buy ratings for Peabody (BTU) and Consol (CNX). The firm says its attractive view on the U.S. coal sector is "tactical," driven by its positive outlook for SXC, BTU and CNX: "While they are not necessarily met-coal focused, higher long-term met coal prices benefit all three." [View news story]

He may be our most accomplished president, I'm convinced he intended from the start to destroy our economy. Now there are comments in newspapers from those who want to give him another chance. Money comes and goes but freedom will be hard to regain.

  • Seattle Genetics (SGEN +4%) gains despite posting a mixed second quarter. Total revenue surged on narrower losses and higher sales of its lymphoma drug Adcetris, but revenue growth still fell short of analyst expectations, largely due to lofty expectations by the Street on Adcetris sales numbers. [View news story]

  • Evaluating Investment Risk In Microsoft [View article]
The steep incline of long term debt is a smart move with interest rates so low. Pay the debt back with cheep money during the coming inflation. Keep offshore earnings off shore until Romney is president and tax rates are more favorable. Good financial management.

  • NetApp (NTAP +1.7%) is catching a bid as its analyst day gets going (webcast). The Street will be paying close attention to the company's FY13 outlook - the lack of FY13 guidance accompanying NetApp's FQ4 report worried many - as well as its plans to deal with tough competition from EMC in the mid-range and "scale-out" storage markets, and its roadmap for delivering flash memory-based solutions (an area where NetApp is seen as lagging relative to upstarts).  [View news story]
    Why such attention to NTAP?
