You tell a court $149 mln. and the judge has no choice but to believe you unless he/she has a good reason not to, or somebody contradicts you. The past creative accounting that NT is known for, did not unfold in BK court and, therefore, the judge is not allowed to take it into consideration. IMHO, anyways! If anyone knows better, please contribute!

I could not agree with you more. What you just said is absolutely and totally true everywhere in Canada at any time and on any day!
...except it does not apply to the ol' NT! Many, many times, NT had to go abroad to find competent engineers to hire. It was particularly true during the rise of Mitel in the 80s. He used to work in the same building as I did on the main Ottawa campus, although I never met him. He's an inventor too only, very sadly indeed, his patent was issued posthumously!

Without Nortel, Canada's economy is entirely 19th century, if not pre industrial revolution! It is something that, maybe, the immigration minister should think about! The "proximity advantage" [proximity to the US of A, that is] will only go so far in sustaining Canada's position in the G8 crowd, IMHO! Nortel was, by far, the only Canadian company capable of "brain drain" into [as opposed to away from] Canada.

They only started complying with The United Nations INTERNATIONAL COVENANT ON ECONOMIC, SOCIAL AND CULTURAL RIGHTS - Art.15.1.3 - at the start of January 1996 when Jean C. Monty passed Nortel Corp. Policy 400.05 [copies available on request] while still Nortel CEO. The policy was NOT made retroactive to the date when Canada signed and ratified the UN document, but it WAS kept active during the BK proceedings:

For the longest time, NT was under the impression that The Invention and Trade Secret Agreement one signs when joining them "modifies" the UN Covenant. At least that's what the Director of Employee Relations for Eastern Ontario - Larry Schruder - told me! The sky "broke open" sometime in June 1999 when I asked my patent agent W. C. Junkin for a "copy" of the "modified" UN Document! The NT chart "froze" on that day! [Proof of that available on request]
To my knowledge, there is no statute of limitations on these violations and, therefore, the liabilities will persist for at least as long as the brand "Nortel" does.
IMHO, this is the main reason for the Rise and Fall of the Nortel Empire! They started the dot-com bubble with their patents and they ended it the absolute same way! If you don't believe me, then all you have to do is look at the charts of NT and NASDAQ for 1999. NASDAQ started the climb into the bubble a full six weeks after Nortel. Then Nortel started crashing for various reasons and put an end to the bubble! The first of these crashes was on Oct 25th, 2000 long after corporations in the know [PPS, BCE, etc] bailed out of Nortel.
The original stay was granted to allow time for the restructuring. If they want to "extend" that stay, it would have to be for the same reason as the original one was granted for: restructuring. Appending stuff to the original reason [sale of assets] is not the same as changing the reasons all together, IMHO.
About "half-decent offer for its Metro Ethernet Network"...
That's a non issue, IMO. Nortel already accepted a "stalking horse" bid from Avaya. If no better offer comes along, then they'll just have to sell it to Avaya for $475 mln.!! That's all there is to it, as far as I can see!
What I'd really want to talk about is the business of RIMM who wanted to buy the whole company at first, and now only wants the patents which are not -- and they never were -- for sale!! How come?! Is someone going for the "wool over eyes" routine in order to hide something? If "yes", then what are they trying to hide and who are "they" anyways ??!!
