    Well the bit about iphones outselling all Android phones combined is actually incorrect, so it might be prudent next time to quote information that is actually factually correct. Also, the " first 12 weeks of this quarter"...there are only 12 weeks in the quarter so which 12 weeks are you talking about?

    Also, the CEO of AT&T did not say that 77% of their sales were iphones, that information was projected by yet another analyst who based that on the previous quarters percentage, which by the way were all 4S's.

    Oh yes, i nearly forgot. Your assumption, that if Apple has 50% of the projected 1 billion phone sales......you seem to be forgetting that at the moment Apple has around 15% - 17% of the global market, depending on who you read, so perhaps you would be so kind as to tell us quite how you see them jumping from 17% to 50% by 2016 - in 3 years time as we are nearly at the end of 2012....As of now, Android has 72% of the global market and continues to grow much faster than Apple, so I want to know how you see your scenario developing.

    What you fail to realise is that the only pure Android phone on sale at the moment is the Google Nexus. All the other Andriod manufacturers add their own software packages to their products which gives them an individual market presence which is why Android continues to grow and the customer retention is very strong. Trying to dismiss Android because you dont like it is madness. Android is here to stay the same as iOS is. They both service different customer groups and always will do, but if you seriously think Android is dead ( as per your other article ) then you are very much mistaken.

    Point 1 - ( your points ) - where have I mentioned any figures relating to the HTC agreement?....As if happens it a cross licensing deal meaning Apple is also paying HTC something and the figure of $8.00 per item actually comes from an analyst called Shaw Wu, not Samsung.

    Point 2 - Florian is obviously hoping to get work from Apple which is very clear when you read his posts and as I have actually asked him that and it has been confirmed, his views are not necessarily representative of fact. Especially as many other people who are patent lawyers disagree with him. And I dont mean those on Groklaw. Just check out what others are saying.

    Point 3 - How is the actual legal representation being put before the judge a one sided view?.....As to the posts by various people below that, they are irrelevant. It is the actual court transscript that show very clearly that the verdict is in trouble and even Florian says that so dream on..

    I am in France at the moment purchasing wine and antiques for a business I have an interest in, but I have come on here to respond to this, because it is so flawed it is almost unreal.

    Firstly, whilst it looks like HTC had simply surrendered to Apple, remember that a recent court case made it very clear that Apple would not be able to invalidate HTC's patents, therefore, it is very obvious that rather than lose another law suit, Apple have quite rightly come to an arrangement with HTC to end their specific war.

    But if you think other players are going to do so, think again. It will never happen. The only case where apple have " won " a patent case against an Android supply is against Samsung in August and that court case is very likely to be over turned. For one thing, one of the main alleged infringements was related to the " rubber band " or " bounce back " patent which has been invalidated. Therefore, even if the verdict stood, which is very doubtful, the amounts awarded against Samsung will be significantly less than the $1b provisionally listed.

    As to Florian Muller of Foss Patents, it is a total waste of time reading what he says because he is so pro Apple, he probably has iOS instead of blood. What you need to do is read alternative views on the whole legal process, because Florian is in Apple LaLa land and all you will get is a one sided and totally incorrect view which helps no one. I recommend you read Groklaw who has a more accurate view on the Samsung - Apple litigation as their views are actually based on law, not supposition and wishful thinking.

    I suggest you read it because it will show you just how precarious that verdict was and also why Google, Samsung and and other Android supplier are not going to do a deal with Apple. I get so annoyed when I read rubbish like this article. As an investor ( I am long Apple ) I use factual evidence to determine whether an investment is viable, not some delusional fantasy world and that is what this article is, pure fantasy.

    I fall at the alter of Apple and offer myself........lol....no dont get excited. I dont see Apple as a religion at all, to me it is just a stock, but I do see a lot of people who are very protective about it and rip into anyone who dares to question it. To the point where they actually distort and even invent facts that simply dont stand up, so maybe it is a religion to some people. But Applecrat is right, Apple salvation truly is inevitable......

    The thing is Odo, you have to look at Apple in the long term, not the short term because market forces are very volatile and what we are seeing is caused by a number of different factors. Will it resolve itself, yes of course, it may take a few quarters, but the price will go back up again. I personally dont believe it will hit $1000 a share anytime soon and I still think it will fall a bit more, possibly a lot more, so in that sense, it is like gambling. If you cant afford the losses, then dont bet your money, but you will know when the price starts climbing again and it wont shoot up all of the sudden either, as it has gone down, so it will climb, its just a case of when.
    But I dont expect to see that happening to any great degree, this side of Christmas.

    Hmmmm...so the fact that Android has 75% of the market is because they are all buying new phones is it?.....Android 2.3 is still the most prolific version although version 4 is being released as an update for many phones now. But that is irrelevant because we are talking about Apple and were the product side of things running smoothly, there would not be a 4 - 5 week delay and the reason it is not running smoothly is because the 5's design makes it very difficult to assemble and yields of acceptable products, i.e no factory damage, are proving very difficult to produce in high numbers. Yes of course there are millions of people waiting for an iphone, we know this, but what I have yet to see is Apple telling us how they are addressing this issue and until they do, market confidence ( as in the major investors ) will continue to be low and that is the real reason why the share value is dropping. So come on Apple, help us out here and tell us what you are doing to fix this largely self inflicted problem.

    Poor richbar, you do set yourself up for some flak, but I do admire your consistency. I dont think Apple will ever go for the high volume low margin approach. They have a huge customer base who will purchase whatever they produce and although the sales numbers may fall, the margin will be preserved.

    I know where you are coming from though because logically, a company would do this, however, Apple is very different to most companies and they will retain their premium no matter what the market does.
