I bought a bunch at $.99, so it's more than a 10-bagger for me. They don't need to pay a dividend if they can continualy increase NAV and use up their tax loss to avoid taxes for a while. It makes much more sense to buy back stock, which is what they are doing. They are doing all the right things. If someone wants income, they can either find another BDC or sell shares when they need income.

Thanks for the update. I've owned this one for quite a while and not had much to crow about. But I believed, and still believe that England defended the Falklands because they were pretty confident that there was oil there and this looked like a good play on that. It will be interesting to see how it all turns out. NBL is a cflassy outfit. I heard one of their executives talk about what they are doing with regard to a massive offshore Israel gas find. He seemed to have a good handle on all aspects of the situation.

From what I can see, the so-called "dumping" of VIVUS shares before the approval was only selling of shares acquired recently by exercise of options. That's not a lack of faith in the company, the stock, or the drug - just smart portfolio diversification, particularly given the FDA's prior actions and various risks along the way.

It would be foolish to pay a cash dividend, which is double taxed, rather than buy back stock at a 40% discount to NAV (which also raises the future NAV). They aren't perfect managers, but they aren't stupid either. Give them some credit, in that they held on and did not give the lenders equity and kept paying their loan payments until a deal was worked out, thereby keeping the company alive. The stock has gone fom $0.99 (when I bought a bunch of shares) to around $10, at 10-bagger, in less than 5 years. Eventually the NAV will be near the market price and they can switch back and pay a nice dividend. Meanwhile they are using theit capital loss carryforwards to shelter their gains and bujying back stock at a significant discount, with no taxes being paid by shareholders either.

That "mispricing" has been in effect since Ocean Rig went public. One can argue it was in place before then, but it was hard to know how the amrket would price Ocean Rig before it went public. It is hard to know when, or if, that "mispricing" will go away.

Nice article. I am a long time holder of ACAS. Lost a lot in the crash (on paper), but kept the additional shares paid out and bought a boatload at $.99 near the low. Still holding then and enjoying the 900% gain and share buybacks while waiting for dividends to be restored if we ever get above book value again.
