  • Vringo Vs. Google: Ongoing Royalty Prediction [View article]
I appreciate the part where you fess up to being human and are capable of mistakes, takes a strong person to do that publicly. With that being said, I will not be hiring you as a litigator because what I require in that area does not include humanness and mistakes are not an option. I will evaluate your opinion accordingly. Fact based articulation seems to be your MO. And you didn't call us IP first timers ignorant investors. Thanks for your time here.

  • Thoughts On Google's Motion For Leave To File Supplemental Evidence [View article]
I wasn't under the impression that Vringo was not prepared or willing to go the distance?
Solid management, solid legal, solid patents and enough operating cash.
If you are fighting the biggest dogs in the yard, that should be plan A.
The only wild card here, IMO, is European courts.

Vringo has shown their hand early in this play. Why is that? Is this Vringo showing ZTE and the court what a beginning settlement number looks like? Thoughts of injunctions in France still dance in my head. Regardless, it is nice to see what Vringo values its goods at.

As far as any impairment clause goes, only Vringo knows. At 125 mil for the 2013's smartphone sales, maybe there is enough room.

  • Thoughts On Google's Motion For Leave To File Supplemental Evidence [View article]
I have found the timing of the settlement as well as the content most puzzling. Trap door, would fill in some blanks. As been speculated, GOOG rushed in its motion to leave and Vringo has not responded with a reply or a valuation. But what would the leverage be? Vringo saying that when they sat down to negotiate MSFT's willful infringement they used the calc. of 7% of 40% of their US ad revenue and thus valued the patents accordingly? Yes your honor, please use this as relevant evidence that GOOG has asked for.

    Chris

IMO, this sentence has relevancy also.

"Sentiments expressed by the Supreme Court and Federal Circuit have repeatedly held that third-party patent settlements are rarely probative of infringed damages. Payments of any sum in settlement...can not be taken as a standard to measure"

Would Federal Rule of Evidence 408 be used here? It precludes the admission of any settlement related to evidence for the determination of damages.

Thanks for the bread crumbs on the path Marpha

  • The White House officially unveils 5 executive actions and 7 legislative proposals aimed at patent trolls. In addition to previously-reported items (I, II), the White House plans to review ITC procedures for setting import bans, and recommends giving businesses "better legal protection" for using products targeted by suits. Though many tech companies applaud the move, Microsoft (MSFT) is worried it "targets software innovations more broadly." Quartz isn't impressed, arguing (among other things) the action doesn't touch existing patents, and that the USPTO remains understaffed. Potentially affected companies: ACTG, WILN, VRNG, VHC, RPXC[View news story]
Nice read while we are waiting.

It's called Eminent Domain. Government entities have the right to take property and give it to someone else without your consent that would benefit the governing body, with fair market value of course. Good luck with that.
I know this doesn't pertain to patents, but it never ceases to amaze me what Govt. is capable of.

Thanks for the links(lessons). Is that briefing notebook for real or is Sarah Palin working for the White House press staff?

Since GOOG only uses one case law reference, is that enough for a judge to allow the motion and then open this up for all kinds of new evidence? Or is this only for licensing discussion?

  • Vringo: Where's The Money? [View article]
Vringo is going to have to put a value on the patents soon or the judge might see the 1 million settlement that MSFT agreed to as a reasonable licensing example.
Question: will Vringo respond to the motion to leave?

"Marpha is baiting you with extreme contrarian positions"
While I am not sure of his trading positions, I do not think what Marpha is putting out there is contrarian at all. IMO, he is bringing ideas into light that at least needs a small amount of contemplation to have all possibilities examined and appropriate risks applied. I appreciate his view of the room, I need all the help I can get to be a better thinker. Where he loses me is things like " Patent Playgroup"
