    I'm not sure why its so hard to believe that there could possibly be a benefit seen with the medication, since there were so many variables consider. There is the medication up take into the cell and the application of heat for activation, and this may need to occur at a specific time which may not have been easily seen in the study without further scrutiny. It's not like ZIOP where there were no other variables besides the medication. If ZIOP's CEO came out with new information, I could see being upset about that. I would think that if the heat activation of the doxy could be optimized, there could be a significant chance you could see some positive results with this medication, and I wouldn't want to be short the stock if that happens.

    They need to raise some cash. I see share dilution in the picture in the near future. Only question is when? Most likely will happen if there is a nice rise around the May 2nd ADCOM date.

    Any thoughts on the pop seen in ZIOP share price in the last two days? Do you think it will continue to run up until the catalyst or settle back down, since the news is only data collected and not necessarily positive results. Should the comments that they are looking for a partnership be read as they feel strongly that the study results are positive?

    I agree this company is on its way to being profitable and has a strong future, but there is absolutely no new news or catalyst for this stock to be moving higher at this time. I think the stock may continue to run up until earnings report, but will drop back down after earnings are released showing that it still isn't at break even. That's why I think he is trying to pump the stock price as much as possible to profit before earnings, and then take the short position just prior to earnings. Doesn't matter to me, I'm long and know that in a few years it is going to be a very high stock price, but for now, this is not going to be the sustained uptrend.

    Dan - Just wondering if the Judge can make a ruling on the disproportion in damages, only not in favor of GOOG, i.e. change the GOOG damages attributed to $150 mil. to correct what seems to be an obvious math error. GOOG is asking the Judge to decrease the judgement against the other defendants to make it more in line with the 8.5% of the revenue base compared to GOOG, but VRNG will argue that the percentage is off because the jury award against GOOG should have been $150 mil which would also correct the percentage of the other defendants to 8.5% compared to GOOG. Can the Judge increased the damages amount given by the jury? Or if not, can he at least take it into account that it was most likely a math error and base his future royalties on the correct numbers as per given by Becker?

    If the jury is recommending the 3.5% future royalty rate for Google, why is it so hard to believe that they are using 3.5% for the past damages? I think the bigger question is why are the other defendents getting docked 35%.

    The problem is you are multiplying by .35 which would be 35%. If you want to calculate it at 3.5%, multiply the 450,000,000 by .035 and you will get what the jury came up with.

    Still, the shorts are covering today. It's true the percentage of shorts probably went way down last week, but with what looks like an impending favorable verdict for vrng there is a lot of covering going on. I am not sure that it is warranted for this stock to be going up above 3.50 however. That would probably be a fair price for $75-100mm damages. This would not include future royalties.

    There will be huge jump in the stock price, which will be much higher than what Alan has suggested. Not that it would be justified but that's the market.
    It will be a good time for profit taking and for short daytraders as the stock comes back down while waiting for the ruling on future royalties.
    If you thought this trial was a wild rollercoaster ride, the aftermath of a win will make it look like kiddie train ride.

    What the market does and what the market should do are very different. Especially in this case where people have such wildly different opinions of the meanings of different potential outcomes. If vrng loses I can see the stock going well below $1 whether that's justified or not. I wouldn't even be surprised to see a dip in the stock if vrng wins, although I doubt it would happen. The market has a mind of its own.
