    Why do you ignore the alternative upon which the new owner assumes the lease ? Why would the new owner not prefer paying solar city at a much lower rate than the utility ?

    It's not a choice between "default or settling" unless settling refers to having the new owner assume the lease.

    The solar panels do not have to be paid for prior to selling your house.

    I think the presumption of most homeowners is that whomever purchases your home, they would prefer to pay the lower Solar City rates than the utility rates... they would then assume the remaining lease term.

    But the 42.5 NI they lost is 56.7 pretax (at 25% rate) + the pretax restructuring of 26.4 for total pretax of 83.1.... *.35 assumed new tax rate = 54... It seems the more appropriate figure rather than 60... but for all the great work you've done, hardly worth mentioning... :)

    Chris if the tax rate used in the income statement is 25%, then I come up with (42.5/.75 +26.4) X .65 = 54.2

    Seems illogical to bring the 42.5 back to pretax using a 35% rate when 42.5 is after tax at a 25% rate.

    Am I wrong ?

    I can't get past the fact that regulators haven't even pulled the product from the shelves... if carb hasn't seen fit to do that, then I really can't believe in the seriousness of the issue...Tilson may be 100% correct re the test results (as I believe he likely is) but the reaction of the regulators speaks volumes with regard to the actual risk of the product...

    I highlighted a crucial point for you... You say "they said the product was safe to use as intended"... To summarize, the link I provided indicates the flooring could be giving off fumes, particularly early in the installation... open your windows and ventilate your home until the smell goes away... if it doesn't then consider ripping up the floor. Now, most folks aren't going to like the fact that LL sold them non-compliant materials and many may - rightfully or wrongfully - even claim it made them sick. There is significant liability here it's simply a matter of how much it ends up being... and that doesn't even consider whether the deception was perpetrated knowingly or not...

    Zueter: That's a valid argument... that perhaps the damage to LL isn't going to be as bad as is currently reflected in the stock price... but to suggest that everything is fine and dandy and there won't be a problem is absurd. It's simply a question of how bad the damage will end up being.

    Wow... "they said the product was safe to use as intended"... then they followed that up by saying 'the CARB regs are utterly baseless and we should never have issued them'... in fact we are recommending that California get rid of the CARB folks altogether... they aren't worth a hill of beans...
