    As I recall, the "number of gallons" finding results in a "per gallon" dollar penalty under The Clean Water Act. It is a statutory form of punitive damages (as compared to common law punitives based on gross negligence/recklessness.) Thus it is punitive in nature, not compensatory for damages actually suffered by a legal entity. As far as the merits of the appeal/cross appeal is concerned, you are correct that the judge's "finding of fact" will likely be upheld. Appellate courts rarely overturn a finding of fact by a judge or jury (e.g. who ran the red light?), unless the court somehow applied an incorrect legal standard, which seems unlikely.

    The appeal relates to the punitive damage aspect of the case...It's over and above any proveable actual damages. Yes, it is the gov't trying to use BP as a cash cow, just like they did with the Banks. And don't be naive and think the $ will go to something worthwhile like reducing the national debt. Nope, it will go to Obama/Holder's handpicked left wing community activist groups, which will use the money to attack other businesses.

    The ruling was reported about 1 1/2 weeks ago and caused the stock to jump about 5% after bottoming at $35 2 days earlier. I would describe it as "semi-favorable"....the judge made a factual finding as to the volume of oil discharged from the well that was significantly less than the number that was argued for by the gov't. Since the penalties under the Clean Water Act are related to this volume figure, the ruling means significantly less (though still enormous) damages against BP in this portion of the claim.(essentially punitive, not compensatory damages.) The gross negligence ruling has a similar limiting effect on the likely damages under this statute.

    Brad, Nice article. But you may wish to reconsider your apparent infatuation with Dick Vitale. Not only is he an annoying, loudmouth no-nothing (IMHO), but his very brief tenure as coach/general manager of the Detroit Pistons in the late '70s places him in the Pantheon of complete and total sports management failures. To wit, he was completely fleeced by the great Red Auerbach in a trade which gave Red the draft picks (plus the valuable M.L. Carr) to later swing a trade which netted the Celtics Hall of Famers Kevin McHale and Robert Parrish. (Red also fleeced the Warriors in that trade). Somewhere up there Red is still smiling...Red's the guy who would invest in REITS; Vitale would blow it all on penny stocks. (BTW, just having some fun, as a longtime Celtic fan.)

    Agree 100%. This is nothing but a political shakedown by a totally corrupt DOJ. One thing the press has totally downplayed is the fact that large percentages of these settlements won't even be going to the Treasury, but rather to the various parasitic left wing activist groups that will use the $ to continue to prey on the banks. It's really just a stealth tax on BAC shareholders for the benefit of these groups. What traditional legal theory gives them standing to receive this $ from a lawsuit brought by DOJ? Answer: none. (See the editorial in yesterday's Investor's Bus. Daily.) Stick with the regional banks...much less of an easy target.

    My mistake on Buffet/ Berkshire. As to Carey, if the estate is selling the stock, it hasn't yet made its way to the heirs to buy yachts or other goodies. Most likely the estate needs cash for taxes.

    Probably need to raise cash to pay the estate tax; same reason the Mara family sold 50% of the New York Giants to the Tisch family (preemptively to raise the cash for the estate tax before Well Mara's death). Great tax screws family owned businesses. But Buffet loves it...helps sell life insurance.
