Hedge fund Aurelius Capital is offering Clearwire $80M in convertible debt financing as a replacement for the funds it's receiving from Sprint (S). Last week, Crest Financial offered Clearwire $240M in convertible debt financing. For a squeeze-out, the consent of the minority shareholders, is not required for doing a merger, but the acquirer still has a fiduciary responsibility (a responsibility Softbank doesn't want to take on) to the interests of the minority investors. That includes negotiating (in court if need be) a price for the minority shareholders shares. The acquirer does not have the right of "eminent domain" to just take the shares for whatever price that they choose to offer. Holdouts in these deals often get paid off at higher prices, just so that they go away.
Of course, as it stands now, S isn't going to get that 90% of shares, so any squeeze out is a moot point.

When will HLF announce who their new auditor will be. With all those accounting firms lining up for their business, the announcement should have been made today.
Will they investigate the false rumors such as some one ordering a million phones in advance of the USA release? How about the rumor of the Chinese military ordering 2 million phones? The FTC has released 100 complaints from people who paid money to companies that promoted "work from home" opportunities, only to discover later that they were being asked to join Herbalife's (HLF) network and sell its products.
