Also, the jury chose a 3.5% running royalty (non-infringement RR). The day the jury rendered it's verdict, GOOG became a willful infringer. Because of willful infringement, the court has the ability to multiply the non-infringement rate at 2x-3x the RR. Lets assume a max of 10% RR.
Now lets meet somewhere in the middle on all these facts. That's where 5%-7% of 30% is a fairly reasonable judgement based on the facts known.

On the last conference call this past November, VRNG did promise to reveal something that would get investors excited, basically what Ken Lang has been working on all this time, and it was suppose to be announce before the end of the year. It's now March, and I must say I am still curious as to what it could be. Guess it's not ready to be unvealed to stockholders just yet it would seem.
As of now, it's just a waiting game as to what running royalty Judge Jackson will choose, which is why this is being traded so tightly.
Personally, I am realistically expecting 5%-7% of 30% of GOOG's revenues as evidence (slideshow) was shown the patents created an instant 20% boost in GOOG's revenues when they first utilized them, and that the number is more along the lines of 40% as of current. This was the only evidence given at trial by VRGN. If it was anything lower, GOOG would have proffered their own evidence showing a lower revenue #%. Since they did not, this concludes the revenue gain realized by the VRNG patents was more than 40%. Also, GOOG is now a willful infringer, and have been for the past four months.

"I suddenly see everyone is having second doubts because of the judge. I am actually a bit flummoxed by this. I believe the judge has behaved in a very logical and consistent manner.
People are frustrated with the lack of rulings on the motions. Most of this is due to both VRNG and Google. They are the ones that asked for extensions, without contesting them. The judge did what was fair, and granted those extensions.
People are complaining about the judge being biased about the laches issue and three times penalty. I can see where the judge is within his rights to deny. You have to remember, VRNG did not acquire the patents until well after 2006. It is a logical stretch to say they were harmed as far back as six years ago when they did not even own the patents back then. If the judge ruled that way, I can see the logic. Google pulling underhanded tricks aside, a denial of laches is not something that shows incredible bias towards Google. It is just a judge saying, " you didn't own it then, you won't get paid for that time period,"
In case you haven't noticed, the judge in my opinion has been more than fair in the motion extensions. But now, I feel he has tired of this. His last ruling gave them one more day only. It shows he is ready to rule.
I actually think he was ready to rule the day after the trial was over. The only real question brought up in post trial motions was an increase in RR. It is a very valid point, and rightly was pushed back to be ruled on as the last issue. VRNG is the one who asked for a higher RR, so don't blame the judge for taking his time in making that final judgement.
I believe the time has come. Ample time has been given for motions and replies. The seeming unfair judge has just logically been going by the book. This extension of time has been helpful for VRNG. It has allowed Google to show their true colors. Remember, the judge was none to happy with them at the end of the trial.

I have seen no evidence that the judge has changed his opinion and basic frustration with Google.
