5 Failures of SEC Chairman Cox
Another tremendous problem is that the US Government never developed the technological tools to monitor WS and has no way of now differentiating the true from the false.

Congratulations, you win the award for the lamest trial commentary of the week; you missed several items and I can't begin to comment how lame your missive is.

Friday's Turnaround: Raid on the Shorts
Wake up folks, there are basically 6 parties that control the access of information which we consume voraciously on a daily basis (and they're the most powerful lobby in DC) and there is no such thing as judicious oversight to protect the commoner; it was thrown out with the bathwater. Friday was simply an augury of things to come.

You asked for it, and you got it. Welcome to Mundania.

Apple Dropping Akamai in Favor of Google? I Don't Buy It
Yes Brewer. Apple may be looking to create a secondary system on top of their existing relationship with Akemai – let’s call it a privately peered network (like an access road built right next to and running along with a major highway) tied into the major data centers because of the stress on Akemai’s network (with Apple's new offerings) - it would be increased so dramatically due to their new content offerings that they’re looking to limit any possible liabilities/ points of failure that could/ would affect their products, services and stock. Secondly, the solution that I've all to briefly mentioned would reduce their operating expenses with Akemai dramatically.

Apple may simply be looking to create a situation where they're capable of multicasting from the iTunes hub more efficiently; and maybe don't "buy it" because you don't understand the issues surrounding webcast/ broadcast.

Apple's Retail Growth Depends on European Expansion
Just because we haven't been able to identify where the stores are opening across Europe doesn't mean that they're not in the works. I think we may be getting an augury of Apple's planning and let's remember, Apple isn't just the iPhone; as you so eloquently mentioned, Apple's retail operations are a stylish, profit engine. All the best.

iTunes Showdown: Apple vs. Content Owners
NBC wanted 2X what they were getting - ultimately it was greed that killed the deal - NBC's greed (spelled GE). FYI - those involved with the deal know that Apple refused the price increase demanded by NBC because they knew that ultimately the consumer wouldn't spend $4.99 a show (as opposed to $1.99 a show). NBC is going to wind up the big loser here - with a global footprint and aggressive growth strategy (yes, I'm commenting on Apple's ecosystem of products, their current diversification of their content offerings and their growing sets of strategic alliances) there will be countless others ready to step into NBC's place. All the best.

Most of the large content companies with extensive catalogues aren't miffed - they're arrogant and unwilling to change. Things either adapt or die off. Thanks for the note.

Why Apple Should Collaborate With Satellite Radio
The technology already exists - but why would Apple look to utilize Sirius’ or XM’s existing models and strategies rather than create their own? I mean, Apple can get every EN to agree to privately peer with them and allow multicasting through their network; the feeds would be so valuable these networks would peer out of necessity and demand. Furthermore, it would support Apple TV. BTW - Sirius knows it has big problems.

Apple Stores Restock, iPhone Buzz Booms Back
Thanks Carl. I look forwared to the time (in the not so distant future) when analysts actually wake up and start to figure out how Apple's digital ecosystem translates to future earnings; right now its clear that they don't get it. Let's see, there's the release of the iPhone in the US and the imminent release of the iPhone in the global marketplace (Europe, South America, Asia). There's also Apple's slice of revenue share with their carrier partners for all of the aforementioned territories. There's the upcoming release of Leopard, there are new laptops and desktops and new iPods. There's Apple TV and certainly a lot of accessories. Apple also has a new set of strategic alliances, Google, EA, etc. There's Safari for Windows and several newly published and unpublished patent applications; one's that will allow us to interact with our other Apple's and each others Apples. BTW - Apple also get's the benefit of the attendant first to market status and earning opportunities as well as the attendant B2B, B2C and C2C strategies. I'm very pleased to be a shareholder. All the best.

The iPhone's True Market Cap Value: Apple to Double By 2008
Thanks for your note but I'm not sure about the margins you've used in your projections but you're dead on accurate that the iTunes methodology can be consistently built upon for years to come without the need to reinvent the wheel.

Secondly, the estimates for iPhones contained in your missive still fail to include a view for a global marketplace and let’s be clear, it’s both the analysts and the media that have missed the real story.

Under another name I use on another board I shared a few additional thoughts as to what the analysts may have missed as to future earnings and valuation.

First of all, Apple is somehow behind the scenes with Google, lobbying hard for the conditions attached to the new proposed FCC draft rules that could pave the way for companies like Google and Apple to acquire spectrum for the first time.

Secondly, should Google or Apple or a JV ultimately win the auction for radio-spectrum (22 megahertz of spectrum out of a total 60
megahertz), the winning company will be enabled to begin competing with the large providers of broadband service to customers and businesses.

The result of a combination of a VOIP endgame as well as the ability to control
spectrum is HUGE; especially because the goal for hi - tech is to allow end-users and vendors the
ability to attach any device or application to that spectrum.

We all understand that Apple's set of established strategic alliances as well as the addition of several new ones (i.e. major movie distribution companies) in addition to enhancements and refinements on its proven itunes methodology scores big.

Lastly, Apple’s innovation and improvements of processes (core competencies) is second to none and as such, Apple is now uniquely positioned with it's combination of products and
services i.e. hardware, software, distribution, content and
community to leverage B2B, B2C and C2C strategies like never before.

      All the best.

Apple To Convert iPod Nano To Mobile Phone In 4Q -- Analyst
Not exactly accurate. Kevin has failed to substantiate his report and although every wire service has picked up the story and printed it there's really no validity to it either way. However, the filing in reference was published to the public on July 5, 2007. The actual filing date of the application was Nov. 1, 2006. This could mean that Apple is much further along in their planning than anyone really has had a clue about.

Here is the link fo the July 5th publishing:
