    Ackman and his lobbyist allies have set the model for the latest iteration of crony capitalism, the dangerous marriage of government and business interests that poses the most powerful threat to our free-market economy. This model is nearly the reverse of insider trading--publicly betting against a company’s success, and then setting the full force of the federal government against that it. This blatant attempt to manipulate the market is the type of deplorable abuse that gives true free-market capitalism a bad name. For crony capitalists with access to the government regulators who set the rules, it’s an avenue to guaranteed billions with minimal risk. But for average investors--not to mention the thousands of employees who rely on the slandered company for their livelihood--it’s nothing more than white-collar highway robbery.

Without all of the financial, personal and tax facts, you can only speculate as to why he decided this was his best course of action.

    I want to play poker with Matt Stewart..................
    Since Matt has written two articles about HLF in which he references poker, it has shown me that he really has very little understanding of the game. Any decent poker player knows that the object of the game is figuring out what your opponent(s) have because you already know what you have. That's Matt's dilemma with HLF, he has no way of knowing what's going on with the opponent. Hence, he writes fairytale articles hoping to either garner information or stir doubt. This type of poker player is usually separated from his money before the game is over and is referred to as an easy mark.
    I'm free any night and at any location should this game take place.

    Now that those on the short side of this trade have continually expressed their dislike of those that lie and cheat as well as deceive others I would hope that they could also express this disdain for the MIT professor who advised the White House on Obama Care. This guy happens to be an alumni of a frequent commentor on this site and it will be interesting to see if these ethical and moral principles are only subjectively applied which seems to be the norm here. Jonathan Gruber not only guided the White House in their quest to deceive, he also benefited financially to the tune of about 2 million. Business as usual in the good old USA, the country someone stated on here is looked up upon by others.

    tsalvatore, now that you have publicly stated your views on those who lie and cheat, I was wondering how you can explain how this relates to the RWP case. It appears some of the human characteristics you discuss here were a big part of that case. A case that the plaintiff won.

    Son, none of these guys want to tangle with the DeVos family whether they are willing to admit it or not. That's the hypocrisy of their stance against HLF. I still believe that every do good short has failed to factor in the political aspect of this saga or have discounted it meaningless.

    Son, Matt will never respond and believe me he's scoured every available resource to prove he is correct but has come up empty. Think about this for a second. Matt and the fellow shorts point to Herbalife's failing business metrics as a way to prove saturation. What they conveniently omit is that of course business is off because the company is under attack and that may be reason enough for any negative numbers. That's why they keep the heat up. I'm sure that when the attacks either stop or subside, company financials will stabilize. It's basically a self fulfilling prophecy for Matt and he knows it.

    Ah come on.....why do you and the rest of those short subjectively apply your hatred for fraud? Fraud is fraud but only what you think is fraudulant is important. What you seem to conveniently miss in my comment is that every human being makes a decision about what is important to them. Why don't you google the case of RWP Consolidated vs TJS Partners and take the time to read it. A person involved in that case preaches ethics and morality on this site and how HLF lacks both but he saw no problem with his ethical and moral breach as determined by a court of law. My question to you or any other person who dislikes HLF would be what's the difference between this person and the actions you so dislike about HLF? To me one fraud is as bad as the other.
