I didn't check the 28M count issue. But Mr. Fu according to one SEC filing was given 14M ABAT shares or so alone for a patent which he bought from himself via the company and for money which he (allegedly) gave to the company (a sort of capital increase). Plus he bought those 9M shares according to insider info. So he acquired at least ~23M (or 14M) shares. And he obviously had/has options according to the official ABAT response. Didn't check all other SEC filings for other capital increase issues or so. Maybe some more shares for Mr. Fu. Yet no (or 7M @ $0? ) Mr. Fu insider sells were reported so far at all (since 2004). But for 2008 a Fu possession of ~9M shares is reported. So at least there is a big contradiction. Either he sold a lot and didn't report insider trades. Or he possesses much more than those 9..10M, which are (also) mentioned in that recent official ABAT response.

(Of course much of VVR statements are a little off. E.g. there is no misunderstanding problem with Tesla-style Cars vs 2wheelEVs. )

But it is rather obvious (independent of VVR) that there is something severely wrong with filings, share count and insider reports. Which as it justifies a SEC/court case. This is smelling and Mr. Fu obviously tried to profit in questionable style personally.
Question is, if there is really a big fraud going on beyond this violation, e.g. when the same company was bought twice for many millions (which I could not really follow and sort out so far), or even crime issues (which may be exaggerated drama from VVR), or most severe for share holders: The balance sheets could be mostly fictional - because the question arises: How can a company be so profitable at >30% margins even when key officers suck the company.
Are there really assets of ~227.60M in the company now - as reported?
When only a few millions are missing, and were lost to Mr. Fu by unethical practice, thats not so severe, and could perhaps be reversed. But if it is mostly a house of cards?

There is something inconsistent. the SEC should act.

I could not really follow so far, if ABAT likely purchased the same company twice. in ABAT's response there was an answer regarding similar names (with "ZQ"..) but indeed different firms?

(Huang = Wang? just chinese spelling issue?)

Core question still is: did/does ABAT really earn so much with this "normal" Li-Ion battery + 2WheelEV businesses - even if Mr. Fu tries to "earn" very much for himself in addition. Or is it a complete accounting fraud, so that the SEC and Chinese courts could never get back money which was potentially lost to Mr. Fu - because the current EPS & market cap is mostly just a house of cards?

        update:

SCLN: went up rather steep already. While I've still a 1y target of $5.5 I went flat for now. Plan for re-entering at better price and/or shortly before the next earnings which I expect to confirm the growth and undervaluation.

DENN: I'm still convinced this will remain a long-term dying brand never yielding dividends. They reduce shares in accordance with reducing assets and debt... Book-value to remain ever negative. EPS disappearing magically in accounting maneuvers and inflation. Pressure on US lower class wages and unemployment throughout ongoing globalization and automation. No international strategy. They try to go to students. I put DENN on my short radar for the next to years (which price would go up more, or upon certain news)

S: the little operating cashflow is not due to real Net Income. just due to deprecation tricks. They don't get out of margin pressure and negative EPS with DTE's unit in the hands of T. Profitable T will sqeeze S to the wall with killer prices at the low end in the months and years to come. T or VZ would not be allowed to buy S.
Only the cartel authorities could do something about that now. I prepare for short a soon as DTE to T transfer is official.

C: while they would earn well with linear prospects, there will be system pressure for capital increase and regulation to make the bank system more stable. Surprising things lurking in the balance sheets and the whole system due to government debts. Only the SCLN story appears to be convincing to me. They had another earnings speed up surprise now. The high profit margin numbers are driven by the well expanding Zadaxin business alone so far. Very steady growth over the years and recent quarters. Estimates in line. A stock immune to oil prices, debt crisis, Fukushima (Sad to say this is a "potential" for cancer meds) ... The other 2 meds are options for further jumps in addition. Asian potential with reliable US head.

C is a bank. Average earnings chances are still and always threatened by insane balance sheets. Unless speedily growing global debt is balanced by significant taxes on adversely growing multi-millionaire fortunes, the next debt crisis just a matter of time. Banks are about gambling today.

S will be the underdog to balance the monopoly a little - like AMD to Intel.

DENN has insane balance sheet at weak margins. A low cap, no dividend, decreasing local brand, bread and butter business serving more to officers than share holders for the rest of its life.

FFL: questionable earnings estimates. Yet it may be a gambling small cap.
