Like Flyers pointed out, that small matter of 9/11 got in the way. This criticism of SAIC is idiotic. If every company that developed IP commercialized it properly, Xerox would have sold you every single personal computer you had ever purchased. This SA comment is kind of like blaming Stanford for letting Google "get away from them".
2: "VHC's stock already discounts it becoming by far the most successful publicly traded intellectual property NPE (non-practicing entity, aka "patent troll") in history,"
If VHC were a NPE the ITC case would never have been accepted because of its "industry standing" requirement:

The key to both licenses was an ongoing royalty for Release 10 4G Products, which you would never know unless you did deep technical due diligence like...oh... reading the press release:
"Under the terms of the Agreement, VirnetX has agreed to license certain of its patents to Mitel, for a one-time payment to VirnetX and an ongoing reasonable royalty for all future sales through the expiration of the licensed patents as outlined in the Agreement with respect to certain current and future IP-encrypted products."
4: "VirnetX may lose. - especially given in the last trial the jury apparently struggled with its verdict and this time around the defendants have an easier bar for non-infringement."
The Jury "struggled" with nothing except how quickly to rule for VHC. See my previous post -
5: "VirnetX may win, but be awarded a comparatively small amount of damages. It is entirely plausible that the next jury will find for infringement but award an amount immaterial to VHC's current $2B+ market cap, which would likely cause the stock to collapse."
This is "plausible". It is also "plausible" that the Mayan Calendar will end civilization and resolve all patent infringement cases currently before the Eastern District of Texas.
6: "VirnetX may win, but Apple says they have a workaround. A successful workaround strategy would negate the need to pay VirnetX any ongoing royalties, and provide a future roadmap for anyone VHC sues in the future."
Here is the Markman language that APPL would have to workaround for its future products:

Fill us in Seeking Alpha - what part of that will future iPhones not have? Data? Communication Links? Security?

Here is the list of reversals on Patent Infringement Awards involving cases where the Plaintiff had a previous Jury Verdict and successful PTO Reexams on the exact same patents:

This is not what happened, as has been discussed ad nauseum.
