  • The FTC And Herbalife: An Alternative View [View article]
What the author doesn't seem to get is that HLF is run by top level distributors. The schemes that drive the so called demand for the products are devised by them. Direct sales would mean the products need to stand up on their own against the hundreds of competitors. Bottom line, if the distribs are out, the company is toast.

  • New Herbalife-bashing video surfaces [View news story]
Starting to wonder whether Johnson came in thinking he could legitimize the business, only to realize that theres only one modus operandi. The top distribs run this company, Johnson is simply the public-facing spokesperson of the operation. If you are running a mid-cap company and somehow become the highest paid CEO on Wall Street, there is probably some significant risk built into that paycheck.

  • Why Herbalife Is Like Chuck E. Cheese [View article]
"Casinos involve luck, MLMS involve tons of work and hours building a downline."

So, if the aspirational goal is to build a massive downline, how is that not a pyramid scheme? Who's out there retailing?

Your argument is that "most people expect to lose, but they'll get valuable education out of it." Fine with me, but go ahead and try pitching it that way and then see how many people sign up.

Please, stop justifiying this deceptive business model.

Of course this is happening. Fraudsters always leech off govt money (see: for-profit education).

  • Herbalife: Evidence Is Starting To Mount Of An Imploding Pyramid [View article]
Agreed with your assessment. MJ and co were smart to set a low bar for q1 and q2, but they raised FY guidance and also predicted growth to resume in q3. No way this happens.

Great write-up, Duane. I definitely agree that the FTC is unlikely to take the lead on this. The SEC and DOJ, however, may be looking for blood in a post-Madoff world. A terrible q1 earnings release may be the last straw before an announcement.

Thanks for this article Mr Cox. Glad to find another curious soul weighing in on this debacle. I encourage you to read thru the swaths of research already done on this company and MLM in general. You may find that the story is much grayer than you think.

  • Why Herbalife Is Still Illegal - Recruiting To The Pain [View article]
Actually it was quite accurate. Compete is mostly US traffic and the drop in sales was pretty much in line.

Matt, the only thing that matters are the fundamentals. The metrics are telling indeed. Alexa and Google Trends tell a similar story. The rest of the rambling is just noise in this PR heavy debate.

  • Why It's Important For Government To Act Now Versus Herbalife [View article]

It's not an obvious fraud. That's the problem. It's actually quite an ingenious fraud. But, a fraud is still a fraud.

I believe Stiritz, Icahn, and HLF are lobbying aggressively to get the FTC and SEC off their backs in order to clear the path for a foreign buyout. They will point to China and Europe as indications of growth opportunities. They are racing against the clock, however, because it is only a matter of time before those markets begin their implosion.

I have confidence that US agencies know this and, at the very least, will drag their investigations out until there is no sliver of doubt in people's minds that this is a collapsing pyramind.

  • Is Herbalife Actually Selling Anything? [View article]
I find it laughable that HLF supporters are trotting the same company lines (actually, is it the company or your Supervisors feeding you this stuff?) while a serious implosion of business is happening in the US. What's gonna happen when you show up to the next meeting and none of your distributor friends are there anymore? Time to find a new purpose in life, I guess...hopefully one that doesn't involve siphoning money to rats like Doran Andry and Michael Johnson.
