    Agreed. I recall when Cramer had Aubrey McClendon on his show and was touting Chesapeake Energy as a strong buy... just a few months before it tanked. In my opinion, Cramer has always been a bag of wind; whichever way it's blowing.

    I'm not sure that I'm following your reasoning here. BAC's verdict to pay $1.2B is not made worse by its request to get the verdict tossed. Why not save itself the $1.2B if it can prevail on its challenge?

    That's okay with me! The sooner they get out from under the weight of having to divert profits from capital returns to the last major legal threat hanging over its head, the sooner BAC can put its sullied past behind it and really benefit its patient shareholders.

    As a shareholder, my druthers would be to see BAC put the $4B into their litigation reserves. I don't see that a $4B buy back would add that much to the share price of the stock, but would reduce the bite of any ultimate settlement cost.

    Thanks Kai, very informative! This certainly is a perspective that I'm sure not many of us have considered. If your postulation is correct it would go far in supporting the optimism to that year-end $20 or more share price speculation. Let's get this DOJ matter settled and roll!
