Microsoft Corporation (NASDAQ:MSFT) previously unveiled its Windows Phone 7 mobile operating system, which it hopes will give it a greater presence in the rapidly expanding market for smartphones. Phones running the new software will be available on AT&T’s network starting on Nov. 8, said Steven A. Ballmer, Microsoft’s chief executive, at a news conference in New York. Later in the year, the phones will be available from T-Mobile, and in 2011, from Verizon and Sprint. AT&T will initially offer three phones, at $200 each.

Gymboree Corp. (NASDAQ:GYMB) previously reported that Gymboree is investigating potential claims against the board of directors of Gymboree related to Gymboree's agreement to be acquired by Bain Capital Partners, LLC. The proposed transaction is valued at approximately $1.8 billion. Under the terms of the definitive agreement entered into by the parties, it is anticipated that affiliates of Bain Capital will commence a tender offer to acquire all the outstanding stock of Gymboree for $65.40 per share in cash. If the tender offer is successfully completed, it is anticipated that the transaction will close by year end.

Ending a 3-year-old lawsuit, Dell Inc. (NASDAQ:DELL) has recently settled with a North Carolina company that claimed Dell knowingly shipped thousands of faulty computers. Attorneys for Round Rock-based Dell and Advanced Internet Technologies Inc. recently agreed to dismiss the lawsuit, according to a filing with the U.S. District Court for the Eastern District of North Carolina. The filing comes two weeks after the two parties reached a preliminary agreement on the terms of the settlement. Dell officials have said that financial details of the agreement will be kept confidential. AIT’s lawsuit, filed in 2007, accused Dell of shipping at least 11.8 million faulty computers and instructing employees to conceal the problem from users. Dell’s OptiPlex computers shipped during a three-year period had a potential to malfunction 97 percent of the time because of faulty capacitors, the suit alleged.
