Environmental penalties remain unresolved in BP's (BP +1.5%) expected settlement with the DOJ and SEC over the 2010 Gulf of Mexico spill, as BP could be liable for a maximum penalty of $5.4B under the Clean Water Act, rising to as much as $21B if gross negligence is found. Total outstanding liabilities still have the potential to exceed the $38B charge BP has booked so far for the disaster.
